Council Minutes of 9/1/2009 <br />Ordinance No. 2009-95 introduced by Mayor O'Grady was given its second reading. An <br />ordinance authorizing the Director of Human Resources to solicit proposals for the <br />personal services of a third party administrator (TPA) to process health insurance claims <br />and including the purchase of excess insurance coverage for the city health care & <br />hospitalization plans for 2010, and further authorizing the Mayor, subject to approval of <br />the Board of Control, to enter into a contract for said services and insurance, and <br />declaring an emergency. Councilman Barker moved for suspension of the rule requiring <br />three readings noting the legislation had been heard in committee. The motion was <br />seconded by Councilman Gareau and passed unanimously. Councilman Barker moved <br />for adoption. The motion was seconded by Councilman Gareau and passed unanimously. <br />Ordinance No. 2009-95 adopted. <br />Ordinance No. 2009-96 introduced by Councilman Barker on behalf of himself, Mayor <br />O'Grady and Councilman Mahoney was given its second reading. An ordinance <br />amending Section 974.01 (Rules and Regulations) of Chapter 947 (Parks and Recreation <br />Areas) of the North Olmsted Streets, Utilities and Public Services Code in order to <br />prohibit the riding of bicycles at the North Olmsted skate park, and declaring an <br />emergency. Councilman Mahoney moved for suspension of the rule requiring three <br />readings noting the legislation had been heard in committee and it was unanimously <br />recommended for approval. The motion was seconded by Council Member Dailey Jones. <br />Roll call: Mahoney, yes; Jones, yes; Kearney, yes; Brossard, yes; Orlowski, yes; Gareau, <br />yes with comment that the situation that's developing at the skate park is becoming <br />increasingly bad as time goes on. It's not just necessarily the use of bicycles that are at <br />the skate park; but frankly, it's the clientele at the skate park who are not engaging in <br />what he thinks would be appropriate behavior at the skate park. There has been a <br />significant amount of vandalism. We've got a limited amount of resources at the Rec <br />Center, which is struggling financially to meet its obligations. We're down in manpower, <br />and the people we have are spending time fixing the same smashed, broken fences and <br />benches and supplies that are up at the skate park. He supports this because it's a step in <br />the right direction to stop that, but suggests we go further: that we begin to look at how <br />we use that particular park so we can keep it for the kids who want to use it while <br />ensuring that we don't have the clientele destroying what we've invested in. Maybe this <br />is the beginning and the first step toward additional steps to try to make that a legitimate <br />place for children to come and engage in recreation. Roll call continued: Barker, yes. <br />The motion passed unanimously. Councilman Mahoney moved for adoption, and the <br />motion was seconded by Council Member Dailey Jones. Roll call: Mahoney, yes with a <br />comment that he would also echo Mr. Gareau's concerns and the thoughts he expressed. <br />Councilman Mahoney questioned who had introduced the legislation; he thought the <br />Mayor had introduced and he and Mr. Barker came on later. The Clerk explained that <br />Mr. Barker had originally introduced the legislation on behalf of the Mayor and himself. <br />Roll call continued: Jones, yes; Barker, yes; Gareau, yes with his previous comments <br />incorporated into this vote. Roll call continued: Orlowski, yes; Kearney, yes; Brossard, <br />yes. The motion passed unanimously. Ordinance No. 2009-96 adopted. <br />10 <br />
