City Council Minutes of 8/4/2it09 <br />along with intersection Cedar Point Road at Columbia Road will have no restrictions. Lorain <br />Road at Clague, Brookpark at Clague, and the I-480 off ramp at Clague to be no turn on red <br />from 7 a.m. to 9:30 a.m. and 4 p.m. to 6:30 p.m. weekdays. The intersection at Maple Ridge <br />and Clague will be 7 a.m. to 9:30 a.m. and 2:30 p.m. to 5 p.m. on school days. Removed <br />from the ordinance was the intersection at Lorain and Great Northern Blvd. which will <br />remain the same. The committee voted 3-0 in favor of recommending the amended <br />ordinance. Councilman Kearney made a motion to amend Ordinance 2009-79. The motion <br />was seconded by Councilman Orlowski and passed unanimously. Ordinance No. 2009-79 <br />amended. <br />• Ordinance 2009-80, introduced by the Mayor, an ordinance amending Sections 333.01 and <br />337.26 of the Traffic Code, and Section 513.03 of the General Offenses Code, to establish <br />and/or increase the minimum mandatory fines for first time OVI offenders, child restraint <br />system offenses, and certain marijuana possession offenses. The changes in the ordinance <br />will be to increase the minimum, but the judge can charge more. The Law Dept. advised <br />Council that these changes be made to increase the minimum amount of fines a defendant <br />can be charged. The changes are first time OVI from $325 to $475; child restraint system <br />offenses $25 to $35; possession of marijuana as a minor misdemeanor offense shall be fined <br />no less than $100. If the possession of marijuana is a misdemeanor of the fourth degree, the <br />fine shall be no less than $200. Pros and cons were discussed, and the committee voted 3-0 <br />to recommend approval. <br />• Ordinance 2009-72, sponsored by Council Member Orlowski, an ordinance creating new <br />Chapter 1373 of the Building Code, entitled "Building, Zoning, Property Maintenance and <br />other Nuisance Activities," in order to provide for the abatement of public nuisances and the <br />recovery of city response costs incurred as the result of the multiple recurrence of such <br />nuisance activities on residential property located in the city of North Olmsted. This <br />ordinance will be used as an enforcement tool. These fines will only be enforced if the <br />nuisance occurs four or more times in a 12-month period. The fine shall be determined by the <br />city after it determines how many man hours were needed to quell the disturbance. There is <br />an appeal process written into the ordinance. He commends Councilman Orlowski for <br />sponsoring the ordinance and also the Law Director and Safety Director for the guidance and <br />assistance given to Mr. Orlowski. The committee voted 3-0 to recommend approval. <br />• A liquor permit transfer from Standard Oil Company, 25295 Lorain Road, to Convenience <br />Management Services, DBA BP 25295 Lorain Road. (Cl, C2, D6) Councilman Kearney <br />made a motion that Council not object to this transfer. The motion was seconded by <br />Councilman Orlowski and passed unanimously. <br />• A liquor permit transfer from Standard Oil Company, 23425 Lorain Road, to Convenience <br />Management Services Inc., DBA BP at 23425 Lorain Road. (C1, C2, D6) Councilman <br />Kearney made a motion that Council not object to this transfer. The motion was seconded by <br />Councilman Orlowski and passed unanimously. <br />Councilman Brossard, chairperson of the Intra-Governmental Relations Committee: 1) As <br />chairman of the Intra-Governmental Relations Committee, he has received some reappointments <br />from Mayor O'Grady. The first were reappointments to the Housing Council of Lisa Thomas and <br />Walter Spalding for the new term of January 1, 2009 to December 31, 2011 which do not require <br />Council approval. The next reappointment was to the Fair Housing Review Board of Meenal <br />Parikh for the term January 1, 2009 to December 31, 2012. Councilman Brossard made a motion <br />7 <br /> <br />
