~~ <br />Council Minutes of 5/19/2009 <br />presented the resolution and included a 2008 heating and cooling maintenance <br />renewal comparison. Mr. Limpert indicated, as to reasons why LK should be <br />awarded this particular contract under the resolution, that LK has kept the price <br />the same for each department for the past five years that it has operated under this <br />contract. LK has raised the hourly rate for repairs only $4 per hour and has never <br />had any overtime charges. He indicated that Station No. 2 is new for LK this <br />year, but that LK had done some maintenance in 2008 at that fire station. Mr. <br />Limpert indicated this is a North Olmsted-based company and they are more <br />familiar with the heating and cooling systems throughout the various buildings <br />and again noted that the contract was for one year with aone-year option that the <br />city holds. Questions were raised by Council members and committee members <br />in regards to a Westlake company and a Fairview Park company. Mr. Limpert did <br />not include those particular companies in the proposal primarily because they did <br />not come out to the city of North Olmsted and look at our buildings or inspect our <br />properties, and their proposals were not timely submitted for him to prepare the <br />resolution in regards to first reading. At the April 21 Council meeting, the <br />legislation was removed from the agenda and approved unanimously as being <br />held in committee for further examination primarily to inquire as to why the <br />Westlake and Fairview companies were not involved in the "process." The next <br />committee meeting was held on April 28. All committee members were present <br />along with all members of Council. The legislation was again discussed and <br />debated amongst the various members of the administration including Mr. <br />Limpert, and questions were asked by Council members. The matter was then <br />forwarded for second reading at the Council meeting of May 6, 2009. Again at <br />the Council meeting of May 6, 2009, the agenda was amended to remove <br />Resolution 2009-45 and place it back into committee. At the request of <br />Councilman Kearney, additional information was received from the <br />administration. The legislation was again discussed at a committee meeting on <br />May 12, 2009. The issue was again debated. Present at the first committee <br />meeting April 20 and again at this third committee meeting of May 12 was Mr. <br />Neil Ginley, a concerned citizen, along with Mr. James Cotner, another concerned <br />citizen. The feeling was expressed that the quote process was not necessarily <br />serving the residents of the community well in the idea that the LK contract was a <br />bit of a homer. Meaning that a North Olmsted-based company was routinely <br />given the contract year in and year out, and that the quote process used in this <br />particular instance for this particular contract again wasn't serving the residents <br />well. However, at that committee meeting of May 12, it was pointed out by Mr. <br />Limpert that the original first reading of this legislation was on April 7. The <br />proposal signed by a Fairview Park company, Sun Man Heating and Cooling, was <br />actually signed April 9, which would be two days after the first reading of this <br />particular resolution. At that meeting, it was recommended that the legislation be <br />amended to remove the one year city option clause. The committee voted to <br />recommend approval of Resolution 2009-45 with the amendment removing that <br />city option. The next committee meeting was held this evening, May 19, 2009, at <br />7:15 p.m. Present were ail of Council, along with committee members, the <br />Mayor, Service Director.
