Council Minutes of 5/6/2009 <br />18) The Stearns-Cook project is progressing well. Weather permitting, Hastings Drive <br />should be open next week. Hopefully, within a month's time, we will have two-way <br />traffic from I-480 to Dorchester. <br />19) Service Director Limpert and our WWTP management group will be traveling to <br />Peru, Indiana to observe technology that we expect to incorporate into our system for <br />next year. <br />20) Bids are going out for the reconstruction of Dover Center Road, with the selection of <br />a contractor to be made before the end of the month. <br />Councilman Gareau suggested that, during the Memorial Day ceremonies, the names of <br />North Olmsted residents who gave their lives in service to our country be read aloud. <br />Perhaps their relatives who are still living in this area can be invited to the ceremony. <br />Mayor O'Grady thought that was a worthy recommendation, and he will pass it along to <br />the VFW. <br />Law Director Dubelko: 1) Congratulations to everyone who participated in yesterday's <br />elections. <br />2) Civil litigation report: <br />• Szarka v. Board of Zoning Appeals, our city brief will be due on June 2, 2009. <br />• Michael Stinn, administrator of the estate of Kenneth T. Corneliusen, v. Astrid <br />Try, on April 21, the city filed its answer and acounter-claim in this heirship <br />determination action to assert our interest in Ohio estate taxes that will be owed to <br />the city of North Olmsted. <br />• Baker v. Frolo, which is being defended by insurance counsel, on Apri122, 2009, <br />the court granted the city's motion for summary judgment to dismiss all claims <br />against the police officer and prosecutor named in the action based on immunity <br />defense. <br />• Ricardo Shaffer v. city of North Olmsted, the city received a copy of summons <br />and complaint on April 24, 2009 regarding an alleged mistreatment of a prisoner <br />in the city jail. This complaint has been turned over to the city's insurance carrier <br />for coverage and defense. <br />• City of North Olmsted and the International Association of Fire Fighters Local <br />1267, on April 29, 2009, the city filed its memorandum in support of jurisdiction. <br />with the Ohio Supreme Court. The Ohio Municipal League's amicus brief was <br />also filed at about the same time with the Ohio Supreme Court. <br />3) Mike Gordillo, Prosecutor's report for April: total of 219 cases handled; 87 General <br />Offense cases; 132 Traffic cases; 1 trial and 1 conviction. <br />4) Carole Heyward, Fair Housing Administrator reports that a fair housing complaint was <br />filed with the city. Carole conducted an investigation of the complaint, which was based <br />upon alleged ancestry or national original discrimination, and she concluded that there is <br />no probable cause for this complaint. <br />5) There are 27 property maintenance cases pending in the Law Department. The <br />department has filed on 12. Since reported last at beginning of April, 2 new cases were <br />filed and 2 were resolved in April, both with guilty pleas. In the one instance, the city <br />recovered a $300 fine as well as $700 in restitution costs for the city's administrative <br />costs in this matter. In the other, a guilty plea was continued for sentencing. <br />3 <br />
