Council Minutes of 2/3/2009 <br />LEGISLATION <br />', Resolution No. 2009-4 introduced by Mayor O'Grady was given its second reading. A <br />resolution creating a new Citizens' Committee for the purpose of gathering and <br />presenting to City Council projects for consideration for the city's Community <br />Development. Block Grant (CDBG) applications for fiscal years 2010 through 2012. <br />Resolution 2009-7 introduced by Councilman Mahoney on behalf of himself and Mayor <br />O'Grady was given its second reading. A resolution accepting a donation of field <br />reconditions from the North Olmsted Hot Stove League in orde,~ to construct a dugout for <br />Clague Road #1, provide for a maintenance contract for Diamonds #1 and #5 at North <br />Olmsted Park and Diamonds #1 and #2 at Claque Road Park with an optional service for <br />the construction and restoration of the infield and right outfield for the city park at <br />Chestnut Intermediate School and declaring an emergency. <br />Resolution No. 2009-9 introduced by Councilman Orlowski on behalf of Mayor O'Grady <br />was given its second reading. A resolution authorizing the Director of Planning to file an <br />application for a Community Recycling Awareness Grant from the Cuyahoga County <br />Solid Waste District; further authorizing the Mayor to accept the grant, if awarded; and <br />declaring an emergency. Councilman Orlowski moved for suspension of the rule <br />requiring three readings noting the legislation had been reviewed in committee, the <br />application is time sensitive, and the committee recommended approval to all of Council. <br />The motion was seconded by Councilman Ryan and passed unanimously. Councilman <br />Orlowski moved for adoption. The motion was seconded by Councilman Ryan and <br />passed unanimously. Resolution No. 2009-9 adopted. <br />Ordinance No. 2009-11 introduced by Councilman Gareau on behalf of Mayor O'Grady <br />was given its second reading. An ordinance amending Section 137.01 Composition of <br />Chapter 137 of the Administrative Code, entitled "Department of Law," in order to <br />eliminate certain duties of the Assistant Director of Law -Part-time, and declaring an <br />emergency. Councilman Gareau moved for suspension of the rule requiring three <br />readings noting the legislation had been reviewed in committee, and the reasons for <br />suspension, which he gave in his report, would be for the purpose to get this in effect for <br />purposes of the appropriation ordinance. The motion was seconded by Councilman <br />Barker and passed unanimously. Councilman Gareau moved for adoption, and the <br />motion was seconded by Councilman Barker. Roll call: Gareau, yes; Barker, yes; <br />Mahoney, yes; Jones, yes, with comment. Because of the economic situation that our city <br />faces, she realizes and appreciates the Law Director's leadership within his department <br />regarding this issue. But like many of the cuts that we are experiencing right now, this <br />one hurts as Carole Heyward brings a wealth of knowledge and information to our city. <br />She is thankful that we are able to retain Ms. Heyward as the Fair Housing Administrator <br />for our city. Roll call continued: Ryan, yes, with comment that this is very difficult for <br />him personally because he has had a relationship with the Law Dept. for many years. He <br />knows that Jim Dubelko has done a marvelous job, and he was a great follow-up to <br />Michael Gareau Sr., and he sees that Mike Gareau Jr. is an excellent follow-up too. But <br />it's very difficult when we start making cuts in the Law Dept. because he thinks that's <br />really the brains of the operation. It is difficult to vote yes, but he does.
