It would seem that with this land having <br />housing and storm water retention that the water that may run downhill would not <br />be a factor as with the land wide open. There were residents present who felt that <br />storm water would be a problem and they would get more runoff from the <br />development and there were residents present who felt this project would hamper <br />their property from receiving enough rain water. Mr. Collins stated that, until the <br />project is approved and permits are applied for with detailed reports and prints, <br />some modifications may have to be changed. But until it starts through the <br />process, the preliminary drawings look good. After a 2 hour meeting a motion <br />was made by Mr. Gareau to hold Biddulph Trail Development in committee. The <br />motion was seconded by Mr. Barker and the vote was 3 to 0. The committee <br />discussed the legislation, 2008-117, which had a public hearing on October 17, <br />2008. Many things that were brought up at Planning and Design meetings, as <br />well as the BZD meeting in August, were rehashed. The committee wanted to <br />give everyone involved the chance once again to get all remarks on the record. It <br />was mentioned that the residents involved were pleased with the reception that the <br />BZD Committee gave them to respond. It was his intent, as well as the rest of <br />Council who attended, to give everyone a chance to express their feelings about <br />this proposal. This proposal is a good one but created quite a bit of emotion due to <br />the fact it was being proposed to be developed in the area of the Historic District <br />but actually not in it. The residents of Butternut Ridge were concerned about <br />many things. The Planning Director and Engineer also did an excellent job in <br />answering any and all questions of concern. Councilman Orlowski showed due <br />diligence in representing his constituents as well. After all questions and <br />concerns were discussed, it was determined that the Committee would combine <br />the two issues for a vote, the rezoning Ordinance 2008-117 which covers the <br />parcels in this development and also the Biddulph Trail proposal. It was also <br />discussed that at the Council meeting on January 6, there would be two separate <br />votes. Councilman Orlowski wanted to present some 12 "amendments" to this <br />report with concerns of any future development to the area. It was agreed those <br />would be submitted with this report to be included with the minutes of January 6. <br />At the committee meeting, a motion was made by Chairman Barker to <br />recommend approval of Ordinance 2008-117, the rezoning of P. P. Nos. 236-23- <br />028, 236-23-017, 234-24-019, and 236-24-020 located on Butternut Ridge Rd. <br />from Single Residence to Residential Cluster district and to recommend the <br />Biddulph Trail proposal of 29 cluster homes located at 25747 Butternut Ridge Rd. <br />pursuant to the reccomendations of the Landmarks Commission, the Planning & <br />Design Commission and various other boards and commissions, and with the <br />approval of the Law Department's review of the Condominium documents, and <br />including the lot consolidation. The committee motion was seconded by <br />Councilman Gareau and the vote was 3 to 0 to NOT approve the reccornendation. <br />The committee meeting was adjourned at 9:05 p.m. Councilman Barker made a <br />motion to approve COMS07-0026, the Biddulph Trail proposal located at 25747 <br />Butternut Ridge Rd. pursuant to all of the reccomendations of the Landmarks <br />Commission, the Planning and Design Commission and the various other boards <br />and commissions involved.
