Council Minutes of 1/6/2009 <br />Meredith to the Planning & Design Commission for the term commencing January 1, <br />2009 to December 31, 2013. The motion was seconded by Councilman Mahoney. Roll <br />call: Gareau, yes; Mahoney, yes, reiterating his prior comments that might have been <br />premature, but with the additional comment that he finds the actions of the Intra- <br />Governmental Committee, to be a bit political and shameful. Roll call continued: Jones, <br />yes; Kearney, yes; Orlowski, no; Ryan, no, with comment that he didn't realize that each <br />member wasn't allowed to exercise their independent decisions. It's unfortunate that <br />someone would make those kinds of statements. He would like to point out, which has <br />been pointed out to him many times, that it was an announced meeting and people <br />certainly could have attended. Unfortunately, only Mr. Orlowski and Mr. Ryan were <br />present. So, if somebody else would have attended the meeting and shared these <br />thoughts, maybe someone would have said the motion should pass. Unfortunately, they <br />chose not to attend , so no one was there to make a motion. To be honest, he may have <br />seconded it at the time. Roll call continued: Barker, yes. The motion passed with five <br />yes votes and two no votes. <br />Mr. Ryan asked for a moment of personal privilege and said he has lived in this <br />community 38 years and raised a family of 10 children. He has been the Prosecutor and <br />the Assistant Prosecutor, and this is the first time anyone has criticized him publicly for <br />being politically motivated. He will stand on his record. Every time he votes and does <br />something, it is for the benefit of Ward I. It's unfortunate that people have to make those <br />kind of indications. <br />Councilman Barker, chairperson of the Building, Zoning & Development Committee: 1) <br />The Building, Zoning and Development Committee met on Tuesday December 9, 2008 at <br />7 p.m. in Council Chambers. Present were members Barker, Gareau and Jones; Council <br />members Kearney, Mahoney and Orlowski; President of Council Kennedy; Law Director <br />Dubelko, Planning Director Wenger and City Engineer Collins; representing Biddulph <br />Trails were Mr. Zwick, Mr. Liggett and Mr. DeLorenzo; residents. The committee <br />discussed the following: <br />• Ordinance 2008-117 which would re-zone Permanent Parcels 236-23-028, 236- <br />23-017, 234-24-019, and 236-24-020 from Single Residence to Residential <br />Cluster and also the proposal of COMS 07-0026 Biddulph Trail located at 25747 <br />Bitternut Ridge Rd. Thanks to Planning Director Wenger and her staff for putting <br />together the informational binder for all of Council concerning Biddulph Trail <br />Development. It was very helpful in referencing information from all the <br />meetings and reports from all with interest in this project. In the first meeting, <br />Mr. Liggett gave a presentation showing the proposed development of 29 homes <br />on approximately 10.82 acres of ground running north to south on the south side <br />of Butternut Ridge Road located at 25747 Butternut Ridge Rd. The Landmarks <br />Commission was deeply involved in this proposal because it is in the Historic <br />District. In the August meeting, there was a considerable amount of time spent on <br />sanitary and storm water issues. Mr. Collins gave a lengthy report concerning <br />these issues. It is important to note that it is his opinion that the sanitary issue <br />should not be significant and that with the preliminary drawings regarding storm <br />8 <br />
