CITY OF NORTH OLMSTED <br />ORDINANCE N0. 80-133 <br />PACE 4. <br />recommend to Council whether or not to continue said salary. Council <br />shall forthwith review the matter and by majority vote determine whether <br />the employee shall continue to receive his full salary during recuper- <br />ation. <br />For the prupose of this paragraph, sudden and accidental injury <br />shall include such incidents as injury resulting from a motor vehicle <br />accident; smoke inhalation; burns; falling debris or collapse of <br />building; slipping, tripping and falling and the like. It shall not be <br />considered a sudden or accidental injury or incapacity resulting from <br />the lifting of objects, heart failure or heart attacks. <br />Any member of the Department who qualifies for benefits under <br />Paragraph 1 hereof shall be required to pay over to the City any amounts <br />received from the Bureau of Workmen's Compensation as supplemental <br />wages. Further, if at any time the City determines on the basis of <br />medical evidence that an employee is permanently disabled and will no <br />longer be able to carry on his duties then the City may terminate <br />payments and insist that the employee go on a pension program. Any <br />employee who qualifies for the benefit under this paragraph shall not <br />have his accumulated sick time reduced because of a qualified accidental <br />injury which occurred while in the line of duty. <br />SECTION 3: That the employees of the Fire Department of the City <br />of North Olmsted be reimbursed, not to exceed Three Dollars ($3.00) <br />per day for per diem expenses while in attendance at the Fireman's <br />Training School established by the State of Ohio at a place designated <br />by the Fire Chief, which school is for a five (5) week period with <br />twenty-five (25) days of class attendance required. <br />SECTION 4: That there is hereby established certain rights, rules, <br />and regulations with respect to employee grievance procedure. Said <br />grievance procedure is set forth in Exhibit "A" which is attached hereto <br />and made a part hereof. Said grievance procedure shall be incorporated <br />within the rules promulgated and adopted by the Chief of the Fire <br />Department and Safety Director for the governing of the Fire Department <br />in effectuating Civil Service Laws of the State of Ohio and the rules <br />and regulations of the North Olmsted Civil Service Commission. <br />SECTION 5: That the Clerk of Council be, and she is hereby <br />directe o forward a copy of this Ordinance to the Director of Finance <br />in order that the Director of Finance can pay the compensation, as <br />hereinabove set forth, and a copy of this Ordinance shall be forwarded <br />to the Fire Chief, <br />SECTION 6: That Ordinance No. 80-91, adopted July 28, 1980, is <br />hereby repealed, and any other Ordinances or Resolutions or parts of <br />Ordinances or Resolutions inconsistent herewith are hereby repealed with <br />the effective date of this Ordinance. <br />
