(. <br />~ ~„~. <br />e , ~ ', <br />y <br />EXHIBIT "A" <br />GRIEVANCE PROCEDURE <br /> <br />~• <br />The purpose of this document is to outline the procedure to be used <br />to settle grievances between the Fire Department and its employees. The <br />goal of this procedure is to resolve grievances as quickly as possible <br />and to insure efficiency and to promote employee morale. In all cases <br />this procedure is for issues only. <br />Should any employee or group of employees feel aggrieved as a result <br />of any condition arising out of the employee-employer relationship, includ- <br />ing the claim of unjust discrimination on any matter or condition affecting <br />health and safety beyond those normally encountered in firefighting, a <br />settlement shall be sought as follows by the employee. <br />STEP 1. All grievances must be filed, in writing, with the employee's <br />respective shift officer within four {4) working days of the occurrence. <br />The grievance shall be discussed with the employee's senior shift <br />officer, on duty, within two {2) working days of the initial report. The <br />results of the discussion shall be put into a report by the senior shift <br />officer. If such discussion does not resolve the grievance, it shall pro- <br />ceed to the next step. <br />STEP 2. If the employee grievance is not satisfactorily settled in <br />Step 1, he may ask his shift officer to present the matter to the Chief <br />of the Department. If the matter is not resolved in four (4) working days, <br />the Chief will arrange to meet with the employee--and one other representa- <br />tive of the employee's choice. If such a discussion--does not resolve the <br />grievance, it shall proceed,to the next step. <br />STEP 3. The grievor may transmit his grievance to the Safety Director <br />in writing. At his discretion the Director may meet with the grievor and <br />his representative. In all cases the Director shall answer the grievance <br />in writing within five (5) working days. <br />STEP 4. If the grievance is not satisfactorily settled at Step 3, <br />the employee may within fifteen (15) calendar days after receipt of the <br />Step 3 answer, submit the matter to the Mayor in writing. The Mayor, at <br />his discretion, may meet with the grievor. In all cases the Mayor's deci- <br />sion will be final. <br />No grievance will be processed unless it is filed within the time limit <br />established for filing grievances. If a grievance is not processed to the <br />next step within the time limits established in the Grievance Procedure, <br />the grievance will be deemed to be settled~on the basis of the City's <br />last answer. <br />The time limits set forth in the Grievance Procedure shall, unless <br />extended by mutual written agreement of the City and the employee, be <br />binding on both parties. "Working days" as used in the Grievance Pro- <br />cedure shall not include Saturdays, Sundays, or Holidays. "Working day" <br />is defined as a fire service day. <br />
