J. For the purpose of this Ordinance, the following provisions apply with respect to hours worked and conditions of employment: WORK SCHEDilLE AND OVERTIME 1. The regular work schedule for Fire Prevention personnel shall consist of five (5) consecutive eight (8) hour days, Monday through Friday. Firefighting platoon personnel shall have an average of fifty-six (56) hour duty week consisting of twenty-four (24) hour shifts on a three (3) platoon basis. 2. Normal hours for employees working a forty (40) hour week shall be from 8:00 a.m. until 4:00 p.m. These sched- ules are subject to adjustment by the Chief. 3. Any time worked in excess of eight (8) hours a day and any time worked in excess of forty (40) hours a week, or in the case of firefighting platoon personnel,any time worked in excess of twenty-four (24) hours in a seventy-two (72) hour period shall be considered overtime. All employees, except the Chief of the Department, shall be compensated for autho- rized overtime work at a rate of time and a half of the regular rate of pay calculated by dividing yearly salary by 2080 hours. The Chief will be the determining authority on the necessity for overtime. When compensatory time is desired, the employee will determine, subject to the approval of the Chief, when time will be taken. The minimum time to callback shall be for two (2) hours. 4. Compensatory time cannot be transferred from one employee to another employee. K. In the event that a member of the Fire Department of the City of North Olmsted should be injured while in the line of duty due to a sudden and accidental occurrence and such injury has so incapacitated said member of the Fire Department that he is temporarily unable to work, then the Director of Public Safety, after determining that said injury is work related and is of a temporary nature, may authorize full payment of the employee's regular salary for a period of not more than ninety (90) days. If after said ninety (90) day period, said employee is still temporarily incapacitated, then the Director of Public Safety shall rec- ommend to Council whether or not to continue said salary. Council shall forthwith review the matter and by majority vote determine whether the employee shall continue to receive his full salary during recuperation. For the purpose of this Paragraph, sudden and accidental injury shall include such incidents as injury resulting from a motor vehicle accident; smoke inhalation; burns; falling debris or collapse of building; slipping; tripping and falling, and the like. It shall not be considered as sudden or accidental injury or incapacity resulting from the lifting of objects, heart failure or heart attacks.
