,, <br />-CT_TY OF NiH OLMSTED <br />` ORDINANCE N0. 80-29 <br />-i AGE 21 <br />~(c) Neither the Grantee nor the City shall tap or monitor <br />or arrange for the tapping or monitoring, or permit, either express- <br />ly or impliedly, any other person to tap or monitor any cable, line, <br />signal input device, or subscriber outlet or receiver for any pur- <br />pose whatsoever, without the express written permission of the sub- <br />scriber; provided, however, that the Grantee shall be entitled to <br />conduct system-wide or individually-addressed "sweeps" for the <br />purpose of verifying system integrity, controlling return-path <br />transmission, or billing for pay services. <br />(d) The Grantee, or any of its agents or employees, shall <br />not, without the specific written authorization of the subscriber <br />involved, sell, or otherwise make available to any party (1) lists <br />of the names and addresses of such subscribers, or (2) any list <br />which identifies the viewing habits of subscribers, except as <br />the same is necessary for the construction, marketing and mainten- <br />ance of the Grantee's facilities and services hereunder and the con- <br />comitant billing of subscribers for said services. The Grantee <br />shall not provide information concerning the viewing habits of <br />individual subscribers to any party for any purpose whatsoever. <br />(e) Except as otherwise required by the F.C.C. Rules for <br />Cable Television, Grantee shall exercise no control over program <br />content on any of the access channels. <br />(f) Liability for obscenity, defamation or invasion of pri- <br />vacy on any access channels shall rest with the person, group of <br />persons, or any organization or corporation utilizing said access <br />channels. <br />(g) Any party convicted of a violation under Subsections (c) <br />or (d) of this Section shall be subject to a fine of not less than <br />Two Hundred Fifty Dollars ($250.00) and/or imprisonment of not less <br />than thirty (30) days for each violation. <br />(h) Should the Grantee be convicted of a violation under <br />Subsections (c) or (d) of this Section, the Grantee shall be sub- <br />ject to a fine not to exceed Ten Thousand Dollars ($10,000.00) <br />per violation. <br />SECTION 30: NORTH OLMSTED CABLE TELEVISION ADVISORY COMMISSION <br />(a) There shall be established a citizens' advisory commission <br />entitled the North Olmsted Cable Television Advisory Commission. <br />The Advisory Commission shall consist of five (5) members, two (2) ap- <br />pointed by the Mayor and three (3) appointed by the Council, who shall <br />serve without remuneration. Appointments to the Advisory Commission <br />shall be made without regard to race, creed, color, sex, national <br />origin, or religion, and appointees may not be employed by, nor <br />have any interest in, the broadcasting, cable television, or tele- <br />phone business. Non-residents of the City who possess sufficient <br />qualifications to perform the duties imposed herein may be considered <br />for appointment to the Commission. Appointments to the Commission <br />shall, so far as is practicable, include individuals having expertise <br />or experience in such areas as: <br />(1) Law <br />(2) Science and technology relating to cable television. <br />(3) Member of Council <br />(4) Education <br />(5) Consumer affairs relating to cable television. <br />(6) Economics relating to cable television. <br />(b) Members shall serve for three (3) year terms, except <br />that the terms of three (3) of the first members of the Advisory <br />Commission shall be for two (2) year terms. Vacancies shall be <br />filled by appointment or approval by the Council. <br />
