CITY OF N(~_ d OLMSTED <br />ORDINANCE N0. 80-29 <br />'rAGE 5 ~ ' <br />(f) Whenever in any place within the City all or any part of <br />the electric and telephone utilities shall be located underground, <br />it shall be the obligation of the Grantee to locate or to cause its <br />property to be located underground within such places. If the <br />electric and telephone utilities shall be located underground in <br />any place within the City after the Grantee shall have previously <br />installed its property, the Grantee shall, nevertheless, at the <br />same time or immediately thereafter, remove and relocate its prop- <br />erty also underground in such places. If the Grantee shall in any <br />case be unable for operational reasons only to locate or relocate <br />any part of its property underground, then in that event the Mayor, <br />upon being satisfied as to the facts thereof, may permit such pro- <br />perty to remain above the ground even though other facilities may <br />be placed underground in the area. However, any such permission <br />shall be upon such conditions as the Mayor may require for the <br />public health and welfare. Any facilities of the Grantee placed <br />underground at the property owner's request, in an area where <br />electric or telephone facilities are aerial, shall be installed <br />with the additional expense paid by the property owner. <br />(g) Grantee shall have the authority to trim trees upon <br />and overhanging streets of the City so as to prevent the branches <br />of such trees from coming in contact with Grantee's wires and <br />cables, all trimming to be done under the supervision and direc- <br />tion of the City and at the expense of the Grantee. <br />(h) In case of disturbance of any street caused by the <br />Grantee, the Grantee shall, at its own cost and expense and in <br />a manner approved by the Mayor, replace and restore such street <br />in as good a condition as before the work involving such disturb- <br />ance was done. <br />(i) The Grantee shall, upon request of any person holding <br />a building moving permit issued by the City, temporarily remove, <br />raise or lower its wires to permit the moving of buildings. The <br />expense of such temporary removal or raising or lowering of the <br />wires shall be paid by the person requesting the same, and the <br />Grantee shall have the authority to require such payment in ad- <br />vance. The Grantee shall be given not less than seventy-two (72) <br />hours advance notice to arrange for such temporary wire changes. <br />SECTION 7: CONSTRUCTION STANDARDS <br />(a) The Grantee shall at all times employ ordinary care and <br />shall install and maintain devices or systems for preventing failures <br />and accidents which are likely to cause damage, injuries or nuisances <br />to the public. <br />(b) The Grantee shall install and maintain its wires, cables, <br />fixtures, and other equipment so as not to interfere with equipment <br />of any utility serving the residents of the City or any other entity <br />lawfully and rightfully using the conduit, pole or other part of <br />the right-of-way. <br />(c) The cable television system shall at all times conform <br />to the construction and maintenance standards set forth in the <br />Grantee's application and to the standards set forth below: <br />(1) (A) Methods of construction, installation, and mainten- <br />ance of the City's cable television system shall comply with the <br />National Electrical Safety Code 1978 (ANSI CI-1978) to the ex- <br />tent that such code is consistent with local law affecting the <br />the construction, installation, and maintenance of electrical <br />supply and communications lines. To the extent that such code <br />is inconsistent with other provisions of this franchise or with <br />local law, the latter shall govern. <br />(1) (B) Any tower constructed for use in the City's cable <br />television system sl-Lall comply with the standards contained in <br />Structured Standards for Steel Antenna Towers and Antenna Sun- <br />porting Structures, EIE Standards RS-222-A, as published by <br />the Engineering Department of the Electronic Industries As- <br />sociation, 2001 I Street, N.W., Washington, D. C., 20006. <br />
