.~•ITY OF N(,,~-3 OLMSTED <br />ORDINANCE N0. 80-29 <br />• t AGE 6 <br /> <br />:.~ <br />(1) (C) Installations and physical dimensions of any <br />'tower constructed for use in the City's cable television <br />system shall comply with all appropriate Federal Aviation <br />Agency regulations including, but not limited to, Objectives <br />Affecting Navigable Airspace, 14 C.F.R. 77.1 et seq., Feb- <br />ruary, 1965. <br />(1) (D) Any antenna structure in the City's cable tele- <br />vision system shall comply with Construction, Marking and <br />Lighting of Antenna Structure, 47 C.F.R. 17.1 et seq., <br />September, 1967. <br />(1) (E) All working facilities and conditions used dur- <br />ing construction, installation and maintenance of the City's <br />cable television system shall comply with the standards of <br />the Occupational Safety and Health Administration. <br />(2) Each cable distribution system of the public streets <br />shall comply with all applicable laws and ordinances and govern- <br />mental regulations regarding clearances above ground. <br />(3) The Grantee shall at all times use ordinary care <br />and shall install and maintain in use commonly-accepted meth- <br />ods and devices for preventing failures and accidents which <br />are likely to cause damage, injuries or nuisances to the public. <br />(4) The Grantee shall construct and operate the system <br />and related facilities in accordance with all generally-accepted <br />related industry codes, standards and recommendations that are <br />applicable. <br />(d) All conductors, cables, towers, poles and other components <br />of the system shall be located and constructed by the Grantee in back <br />of street curbs so as to provide minimum interference with access by <br />adjoining property owners to the streets and public ways, and no <br />pole or other fixture of the Grantee shall be placed in the public <br />way so as to interfere with the usual travel on such public way. <br />SECTION 8: SUPERVISION BY THE CITY <br />(a) The Grantee shall construct, operate and maintain the <br />cable television system subject to the supervision of all of the <br />authorities of the City who have jurisdiction in such matters and <br />in strict compliance with all laws, ordinances, and departmental <br />rules and regulations affecting the system. <br />(b) The cable television system and all parts thereof shall <br />be subject to the right of periodic inspection by the City. <br />(c) The Mayor may, from time to time, issue such reasonable <br />rules and regulations concerning the construction, operation, and <br />maintenance of the cable television system as are consistent with <br />the provisions of this Ordinance. <br />(d) If, at any time, the powers of the City Council or any <br />agency or official of the City are transferred by law to any <br />other board, authority, agency or official, then such other board, <br />authority, agency or official shall have the powers, rights and <br />duties previously vested under this Ordinance in the City Council <br />or any agency or official of the City. <br />SECTION 9: GRANTEE'S DUTY TO REMOVE ITS PROPERTIES FROM THE PUBLIC <br />STREETS <br />(a) Following the Grantee's commencement of services through <br />and over its cable television system, the Grantee shall promptly re- <br />move from the public streets where its properties are located all <br />or any part of its facilities so located when one or more of the <br />following enumerated conditions occurs: <br />(1) The Grantee ceases to operate its system for a <br />continuous period of twelve (12) months from the date of <br />said occurrence; <br />
