' ~LITY OF NO'H OLMSTED <br />.~ .ORDINANCE N0. 80-29 <br />PAGE 7 <br /> <br />(2) The Grantee fails to construct said system as here- <br />inbefore and hereinafter provided; <br />(3) The franchise is terminated or revoked pursuant to <br />notice as provided in Section 25 hereof; or <br />(4) The City elects not to renew the franchise at the <br />expiration of the initial franchise period, as provided in <br />Section 24 (f) hereof; <br />provided that the Grantee shall be entitled to receive notice <br />in writing from the City setting forth one or more of the oc- <br />currences hereinabove enumerated, or such other occurrence <br />hereinbefore or hereinafter provided, and that the Grantee <br />shall have ninety (90)days from the date upon which said <br />notice is received to remove said properties as hereinabove <br />required. <br />(b) The Mayor is herein and hereby authorized to enforce <br />the provisions of this Section as hereinafter provided: <br />(1) The Mayor shall notify the Grantee in writing of <br />any occurrence provided for in this Section. Within one <br />hundred eighty (180) days following receipt of said notice, <br />the Grantee shall remove from the streets of the City upon, <br />over and under which its properties are located all of said <br />properties, unless otherwise authorized and permitted by <br />the Mayor. <br />(2) The Mayor may declare abandoned any property of <br />the Grantee remaining in place one hundred eighty (180) <br />days after notification from him as hereinabove provided, <br />and the same shall be considered permanently abandoned <br />property unless the Mayor extends the time for removal <br />of said property for good cause shown. <br />(c) Any property abandoned by the Grantee as hereinabove <br />or hereinafter provided shall become the property of the City, <br />and the Grantee agrees to execute and deliver an instrument in <br />writing transferring its ownership interest in any such property <br />to the City, provided that any notice given the Grantee by the <br />Mayor as provided in this Section shall be deemed notice to any <br />other persons claiming interest in said property of the Grantee, <br />and said persons shall be subject to all the provisions herein- <br />before provided. <br />SECTION 10: REMOVAL OF FACILITIES UPON REQUEST <br />Upon termination of service to any subscriber, the Grantee <br />shall promptly remove all of its facilities and equipment from the <br />premises of such subscriber upon his written request. <br />SECTION 11: CONSTRUCTION PLAN; PROGRESS REPORTS <br />(a) The Grantee shall submit with its application for the <br />franchise a plan for the entire City indicating the date on which <br />the Grantee expects the installation of the cable television sys- <br />tem to be completed and available for service to subscribers in <br />the various areas of the City. <br />(b) The Grantee shall furnish the Mayor with progress re- <br />ports indicating in detail the degree of construction of the sys- <br />tem. Such periodic reports shall be made at six (6) month inter- <br />vals, the first report to be made six (6) months from the date of <br />initial construction. <br />SECTION 12: SERVICES AND FACILITIES; TECHNICAL STANDARDS <br />(a) Services and Facilities: <br />(1) The cable television system contemplated herein <br />shall have a minimum channel capacity of thirty-five (35) chan- <br />nels with a minimum of twenty (20) channels available for im- <br />mediate use. <br />
