. CITY OF NO:~~ OLMSTED ~__ ~~ ORDINANCE N0.80-29 ~P'AGE 8 (2) Such system shall maintain a plant having the technical capacity for non-voice return, or "two-way" communications. (3) The Grantee shall maintain the following: (A) At least one (1) specially-designated, non- commercial public access channel available on a first- come, non-discriminatory basis; (B) At least one (1) specially-designated channel for use by local educational authorities; (C) At least one (1) specially-designated chan- nel for leased access uses; and (D) At least one (1) specially-designated channel for local governmental uses; provided, if there is not an initial demand for activa- tion of all four (4) access channels, Grantee may com- bine access programming on one (1) such channel until such time as the Council determines that additional channels are necessary. Said determination shall obli- gate Grantee to activate one or more of the separate channels herein listed. (4) The Grantee shall have available equipment for local production and presentation of cablecast programs other than automated services and shall permit its use for the production and presentation of public access programs. (5) The Grantee shall incorporate into its cable tele- vision system the capacity which will permit the City, in times of emergency, to override, by remote control, the audio of all channels simultaneously. The Grantee shall designate a channel which will be used for emergency broadcasts of both audio and video. The Grantee shall cooperate with the City in the use and operation of the emergency alert override system. (6) The Grantee shall be permitted and may be required by the City to extend its facilities to the City's boundaries to interconnect the North Olmsted Cable Television System with other Broadband Communication Facilities operating in an area adjacent to the City or within the Greater Cleveland area without charge to the City or any subscriber or user. Such interconnection shall be accomplished according to the method and technical standards accepted to the City, and shall be made within the time limits prescribed by the City. "Broadband Communications Facility" as used herein, means any network of cable, optical, electrical or electronic equipment, including Cable Television Systems, used for the purpose of transmitting telecommunication signals. (7) The Grantee shall provide such additional services and facilities as are contained in its application, which is hereby incorporated by reference herein. (b) Technical Standards: (1) Grantee shall comply fully with the technical rules and standards for cable television operations as adopted by the Federal Communications Commission, 47 C.F.R. Part 76, Subpart k. (2) The cable system shall be capable of delivering all National Television Systems Committee color and mono- chrome standard signals (developed and presented to the F.C.C. on July 21, 1953) to standard Electronic Industries Association approved television receivers without notice- able degradation.
