CITY OF NO:~~ OLMSTED ~__ <br />~~ ORDINANCE N0.80-29 <br />~P'AGE 8 <br />(2) Such system shall maintain a plant having the <br />technical capacity for non-voice return, or "two-way" <br />communications. <br />(3) The Grantee shall maintain the following: <br />(A) At least one (1) specially-designated, non- <br />commercial public access channel available on a first- <br />come, non-discriminatory basis; <br />(B) At least one (1) specially-designated channel <br />for use by local educational authorities; <br />(C) At least one (1) specially-designated chan- <br />nel for leased access uses; and <br />(D) At least one (1) specially-designated channel <br />for local governmental uses; <br />provided, if there is not an initial demand for activa- <br />tion of all four (4) access channels, Grantee may com- <br />bine access programming on one (1) such channel until <br />such time as the Council determines that additional <br />channels are necessary. Said determination shall obli- <br />gate Grantee to activate one or more of the separate <br />channels herein listed. <br />(4) The Grantee shall have available equipment for local <br />production and presentation of cablecast programs other than <br />automated services and shall permit its use for the production <br />and presentation of public access programs. <br />(5) The Grantee shall incorporate into its cable tele- <br />vision system the capacity which will permit the City, in <br />times of emergency, to override, by remote control, the audio <br />of all channels simultaneously. The Grantee shall designate <br />a channel which will be used for emergency broadcasts of both <br />audio and video. The Grantee shall cooperate with the City <br />in the use and operation of the emergency alert override system. <br />(6) The Grantee shall be permitted and may be required <br />by the City to extend its facilities to the City's boundaries <br />to interconnect the North Olmsted Cable Television System <br />with other Broadband Communication Facilities operating in <br />an area adjacent to the City or within the Greater Cleveland <br />area without charge to the City or any subscriber or user. <br />Such interconnection shall be accomplished according to the <br />method and technical standards accepted to the City, and <br />shall be made within the time limits prescribed by the City. <br />"Broadband Communications Facility" as used herein, means <br />any network of cable, optical, electrical or electronic <br />equipment, including Cable Television Systems, used for <br />the purpose of transmitting telecommunication signals. <br />(7) The Grantee shall provide such additional services <br />and facilities as are contained in its application, which is <br />hereby incorporated by reference herein. <br />(b) Technical Standards: <br />(1) Grantee shall comply fully with the technical rules <br />and standards for cable television operations as adopted by <br />the Federal Communications Commission, 47 C.F.R. Part 76, <br />Subpart k. <br />(2) The cable system shall be capable of delivering <br />all National Television Systems Committee color and mono- <br />chrome standard signals (developed and presented to the <br />F.C.C. on July 21, 1953) to standard Electronic Industries <br />Association approved television receivers without notice- <br />able degradation. <br />
