Resolution No. 2009- 122 SECTION 1: That the Director of Public Service be and is hereby authorized to apply for a Transportation for Livable Communities Initiative grant from the Northeast Ohio Areawide Coordinating Agency (NOACA) in order to receive technical support from NOACA staff for Intersection signal improvements for the Lorain-Porter-Butternut Ridge Road intersection and the Lorain-Brookpark Road intersection, and that this Council approves the use of City funds in a maximum amount of twenty percent (20%) but in no event to exceed eighteen thousand dollars ($18,000.00) for the local match for said grant. SECTION 2: That the Mayor be, and he hereby is, authorized to accept said grant, if awarded, on behalf of the City of North Olmsted and to execute a contract, if required; and that the Director of Public Service be, and hereby is, authorized to execute all other non-contract documents necessary to effectuate receipt of the grant. SECTION 3: That this Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare and for the further reason that it is necessary that this legislation go into effect immediately in order to meet the grant application deadline of October 9, 2009; and further provided that it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
