30.03 Each employee who is entitled to leave provided under paragraphs 30.01 and/or 30.02 of <br />this Article shall submit to the Employer the published order authorizing the call or order to the <br />uniformed services or a written statement from the appropriate military commander authorizing <br />that service, prior to being credited with such leave. Upon return from such military leave, each <br />such member shall, within thirty (30) days following his or her return, submit to the Director of <br />Finance military documentation which sets forth the amount of base military pay that the <br />member received during the period of his or her leave of absence. <br />30.04 The benefits provided for in this Article are expressly in lieu of the military leave benefits <br />provided for in Section 5923.05 of the Ohio Revised Code, including the first 30-day benefits <br />contained in paragraph (A) of said Section 5923.05, for members who are called or ordered to <br />the uniformed services, pursuant to one of the categories of orders set forth in paragraph 30.01 <br />above, for a period or periods longer than a month, for each calendar year in which the employee <br />performs service in the uniformed services. This Article is not, however, intended to supplant <br />the benefits provided in paragraph (A) of Section 5923.05 for those employees who are members <br />of the Ohio organized militia or members of other reserve components of the armed forces of the <br />United States, including the Ohio national guard, who are entitled, pursuant to that paragraph, to <br />leaves of absence from their respective positions without loss of pay for the time they are <br />performing service in the uniformed services, for periods of up to one month, for each calendar <br />year in which they are performing service in the uniformed services. In addition, this Article is <br />not intended to supplant any other military leave benefit to which employees may be entitled <br />pursuant to any other section of the Ohio Revised Code. <br />ARTICLE XXXI SEPARATION BENEFIT <br />31.01 Upon retirement, separation or disability separation, not including termination for cause <br />or mental disability from the Employer employees will be permitted to purchase their service <br />weapon for the sum of one ($1.00) dollar. <br />31.02 Any employee serving in the K-9 unit who retires or has a separation of employment or <br />suffers a disability separation (applicable also to canine), not to include termination for cause, <br />will be permitted to purchase their canine partner for the sum of one ($1.00) dollar. <br />ARTICLE XXXII <br />DRUG TESTING WITH BWC <br />32.01 For the purpose of implementing the provisions of this article, each bargaining trait <br />member shall execute medical releases in order for the City to obtain the results of the <br />examinations/drug screen testing provided for in this Article and the City's Drug Testing <br />Procedures per the City of North Olmsted Drug Free Workplace Policy. <br />32.02 The drug testing policy shall be the drug free workplace plans established by the Bureau <br />of Workers' Compensation (BWC). It is further agreed to by the FOP and the Employer that <br />only BWC Level 1 Drug Free Workplace Policy will be implemented by the parties, without <br />random drug testing. <br />21 <br />
