<br />,~.,.~. <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0.2009 -112 <br />By: Mayor O'Grady <br />AN ORDINANCE AMENDING SECTION 911.18 ("GRIEVANCES AND <br />APPEALS') OF CHAPTER 9l1 ("SEWERS GENERALLY') OF THE <br />STREETS, UTILITIES AND PUBLIC SER VICES CODE IN ORDER TO <br />CLARIFY THE CITY'S PROCESS FOR RESOLVING GRIEVANCES <br />REGARDING EXTRAORDINARYSEWER CHARGES. <br />WHEREAS, Section 911.18 of Chapter 911 of the Streets, Utilities and Public <br />Services Code provides generally for the Director of Public Service to receive <br />complaints and grievances from users of the public sewers and for a process to adjust <br />such complaints; and <br />WHEREAS, the Director of Law has recommended that said Section 911.18 be <br />amended to clarify the authority of the Director of Public Service to make or recommend <br />equitable adjustments in extraordinary sewer bills; and <br />WHEREAS, it is the desire of this Council, acting upon the said recommendation, <br />to appropriately amend said Section 911.18 in order to clarify the authority of the <br />Director of Public Service and to improve the process for receiving and adjusting <br />complaints from users of the public sewers; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That Section 911.18 of the North Olmsted Codified Ordinances <br />entitled "Grievances and Appeals," which presently reads as follows: <br />911.18 GRIEVANCES AND APPEALS. <br />Users connected to public sewers or to a private sewage disposal system will have <br />an opportunity to express complaints and grievances to the Service Director. Further <br />appeals may be presented to and investigated by the Environmental Committee, Building <br />Commissioner and Finance Director. If, in their collective opinion, the grievances are <br />justified, an administrative modification may be issued to remove the cause of the <br />complaint. <br />SHALL BE AMENDED, AND, AS AMENDED, SHALL READ IN ITS ENTIRETY <br />AS FOLLOWS: <br />911.18 GRIEVANCES AND APPEALS. <br />Users connected to public sewers or to a private sewage disposal system will have <br />an opportunity to express complaints and grievances to the Service Director, who shall <br />investigate such complaints and grievances.
