<br />CITY OF NORTH OLMSTED <br />ORDINANCE N0.2009 - 96 <br />BY: Council Member Barker, Council Member Mahoney and Mayor O'Grady <br />AN ORDINANCE AMENDING SECTION 947.01 (RULES AND <br />REGULATIONS) OF CHAPTER 947 (PARKS AND RECREATION AREAS) <br />OF THE NORTH OLMSTED STREETS, UTILITIES AND PUBLIC <br />SERVICES CODE IN ORDER TO PROHIBIT THE RIDING OF BICYCLES <br />AT THE NORTH OLMSTED SKATE PARK, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the Parks and Recreation Commissioner has received a number of <br />complaints of persons riding bicycles at the North Olmsted Skate Park; and <br />WHEREAS, the riding bicycles at the North Olmsted Skate Park interferes with persons <br />who are skateboarding at the Park; and <br />WHEREAS, the riding of bicycles at the North Olmsted Skate Park poses a significant <br />risk of injury not only to persons riding bicycles at a Park designed for skateboarding only, but <br />also poses a risk of injury to skateboarders at the Park; and <br />WHEREAS, it is accordingly the desire of this Council, acting upon the recommendation <br />of the Parks and Recreation Commissioner, as well as the Mayor and the Director of Community <br />Life Services, to accordingly amend Section 947.01 of Chapter 947 of the Streets, Utilities and <br />Public Services Code in order to prohibit the riding of bicycles at the North Olmsted Skate Park; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, STATE OF OHIO: <br />SECTION 1: That Section 947.01 of Chapter 947 of the Streets, Utilities and Public <br />Services Code, which presently reads as follows: <br />947.01 RULES AND REGULATIONS. <br />(a) weed Regulated. No vehicle or horse shall be driven or ridden in the City park or <br />recreation site at a speed greater than fifteen miles per hour. <br />(b) Selling_Merchandise. No person, partnership, limited liability or corporation <br />operating for profit exclusive and apart from a nonprofit group or organization shall sell or offer <br />for sale any goods, wares, merchandise or services in the City parks. This shall exclude any <br />agreement the City enters into for the purpose of selling food and non-alcoholic beverages m <br />City parks and shall permit, through express written permission of the City, through the Safety <br />Director, nonprofit groups or organizations to enter into concession agreements for the purpose <br />of selling food and non-alcoholic beverages in City parks for limited special events. <br />
