<br />r.:,~ <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2009 - 94 <br />By: Mayor O'Grady <br />AN ORDINANCE AMENDING ORDINANCE NO. 98-140, AS PREVIOUSLY <br />AMENDED BY ORDINANCE NOS. 2000-29, 2002-183 AND 2006-195, SO AS <br />TO REVISE AND EXPAND THE PROGRAM FEE FOR PARTICIPATION <br />IN THE CITY'S COMMUNITY DIVERSION PROGRAM (CDP) TO <br />INCLUDE DIVERSION OF TRAFFIC VIOLATIONS. <br />WHEREAS, North Olmsted presently charges an $80.00 program fee for participation <br />following juvenile delinquency and unruliness charges, as well as an additional fee ranging from <br />$25.00 to $100.00 in the event of program violation; and <br />WHEREAS, should this Council approve companion legislation to expand the scope of <br />CDP to encompass certain "waiverable" traffic violations, the CDP will require addition <br />participation and violation fees in order to provide diversion services; and <br />WHEREAS, program fees for traffic violation diversion are proposed to range from <br />$75.00 to $120.00, which is comparable to the fees other communities in Cuyahoga County <br />charge, and will enable the City to have sufficient revenues to continue the program in the year <br />2009. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That Section 1 of Ordinance No. 98-140, as amended by Ordinance Nos. <br />2000-29, 2002-183 and 2006-195, which presently reads as follows: <br />"Section 1: That there is hereby established a program fee of eighty dollars ($80.00) to <br />be charged to the parent or other guardian of each juvenile who participates in the <br />Community Diversion Program of the Division of Youth Services. In addition to this fee, <br />each said parent or guardian of a juvenile, who violates the Program's guidelines and is <br />filed upon in Juvenile Court within one year of his or her admission to the program, shall <br />pay an administrative fee which shall be no less than twenty-five dollars ($25.00) and no <br />greater than one hundred dollars ($100.00). Said administrative fee in each case shall be <br />determined by the Administrator of the Division of Youth Services, who shall base it <br />upon the severity of the violation committed. All fees provided for herein, which are <br />collected by the Administrator of the Division of Youth Services, shall be -~.;ed <br />exclusively for Division of Youth Services services, including, but not limited to, <br />programs and interventions for youths and families involved in community diversion." <br />
