~- <br />thereof, and paying for said equipment in full. City acknowledges that the <br />Instructor is now sole owner of the spring floor exercise equipment. <br />9. Obtain approval from the City's Recreation Commission prior to making <br />changes, alterations, improvements, or additions to the second (2°d) floor gym <br />area. All such improvements or alterations are fixtures, and shall remain <br />property of the City. <br />10. Insure that all areas of the gym and the equipment are inspected and certified <br />in writing on an annual basis by qualified personnel and immediately provide <br />written notification of said inspection results to the City. The Instructor shall <br />take immediate remedial action and report to the City. <br />ll.Obtain and maintain general sports liability insurance for gymnastic <br />instruction activities with policy limits of one million/two million and which <br />names the City of North Olmsted as "an additional Insured" party and <br />provides the City with notice of cancellation. <br />The City shall: <br />1. Make the second (2°d) floor gym area available for Instructor's programs <br />during all hours when the Recreation Complex is open. The City will be <br />entirely responsible for maintenance of and any improvements to the building <br />and its facility, with the exception of the spring floor, which the City shall <br />only be responsible for keeping clean. Instructor shall be responsible for the <br />maintenance and repair of all other gymnastics equipment used at the <br />Recreation Complex which Instructor presently owns or subsequently <br />acquires. <br />2. Assist in advertising programs conducted by Instructor, including providing <br />space in seasonal brochures published by the City for publicity of Instructor's <br />programs. The City reserves the right to identify the Instructor as an <br />independent contractor in any and all such promotional materials and shall <br />provide the Instructor with an opportunity to review such disclaimer language. <br />3. Register students in classes conducted by Instructor, and collect fees charged <br />by Instructor, provided that such programs and the fee schedule are previously <br />approved by the City. The Instructor is not to conduct financial transactions. <br />4. Be responsible for cleaning all mats and vacuuming all carpeting in the gyms <br />area. <br />5. Provide reasonable access to office equipment and reasonable amounts of <br />office supplies. <br />6. Grant Instructor access to and use of any and all gymnastic equipment on the <br />second floor area for use during any and all programs operated herein. <br />Further, the City shall review any scheduling changes or conflicts with the <br />Instructor so that established and scheduled gymnastics programs are not <br />relocated or restricted from access to the area and equipment as a result of <br />such scheduling of other programs. <br />Section IV <br />Duration of Employment <br />3 <br />
