The term of this agreement shall be for a period commencing September 1, 2009 and terminating on August 31, 2011. Section V Payment and Reimbursement The City shall pay Instructor and Instructor agrees to accept from the City, in full payment for Instructor's services under this agreement, compensation at the rate set forth herein, based upon the amount collected by the City through registration for programs conducted by Instructor. Payment is to be made on a bi- monthly basis for the compensation earned over the immediately preceding bi- monthlyperiod. Payment percentage distribution, as outlined below, is calculated on a monthly basis (the Instructor returns to 50% distribution), and is based upon all gymnastics programs offered, as evidenced by daily financial reports and reconciled by a general ledger through the Recreation Bookkeeper. The City shall pay to Instructor Fifty (50%) percent of all proceeds from the first One Thousand ($1,000.00) Dollars collected from instructional programming. The City shall pay to Instructor Sixty (60%) percent of all proceeds between One Thousand ($1,000.00) Dollars and Three Thousand ($3,000.00) Dollars collected. The City shall pay to Instructor Eighty (80%) percent of all proceeds above Three Thousand ($3,000.00) Dollars collected. The City shall pay to Instructor Eighty (80%) percent of the gross proceeds of any and all Gymnastics Birthday Party programs collected for and conducted at the Recreation Center. The City shall pay to Instructor Eighty (80%) percent of the gross proceeds of any and all "field trip" programs conducted by the Instructor at the Recreation Center. The City shall pay to Instructor Eighty (80%) percent of the gross proceeds of all "Open Gym" programs established .and operated solely by Instructor. Insurance fees collected in connection with Instructor's services shall be deducted directly from the proceeds collected by the City; however, in the event of an increase in insurance costs after publication of public fees, the City shall bear the cost of the increased insurance fee until a new fee schedule is agreed upon and published. The City and the Instructor agree to consolidate ownership of all gymnastic equipment, whether owned by one party or the other, or as owned by both at various percentages. The parties agree to the inventory and valuation of all such property, as prepared and attached hereto as Schedule A, subject to modification, depreciation, and other adjustments noted therein.
