<br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2009 - 55 <br />BY: Mayor O'Grady <br />A RESOLUTION AMENDING THE CITY'S CONTRACT WITH <br />JOHNSON, MILLER & SCHMITZ (FORMERLY JOHNSON & <br />COLALUCA) IN ORDER THAT IT MAY SERVE AS THE CITY'S <br />LABOR NEGOTIATOR FOR THE VARIOUS COLLECTIVE <br />BARGAINING AGREEMENTS THAT EXPIRED IN 2006 AND 2007 <br />AND AS OUTSIDE COUNSEL IN RELATED ARBITRATIONS <br />BETWEEN THE CITY AND UNIONS REPRESENTING THE <br />SAFETY FORCES, AND DECLARING AN EMERGENCY. <br />WHEREAS, the law firm of Johnson & Colaluca, now known as Johnson, Miller <br />& Schmitz [hereinafter referred to as "Johnson"], was selected through an RFP process <br />conducted in 2006 to serve as the City's labor negotiator in renegotiating the City's <br />various collective bargaining agreements that were scheduled to expire in 2006 and 2007; <br />and <br />WHEREAS, it is the desire of this Council, acting on the request of the <br />Administration, to authorize an amendment to the City's contract with Johnson in order <br />that the law firm may also represent the City as outside counsel in arbitrations between <br />the City and Unions representing the Safety Forces that relate to ongoing collective <br />bargaining negotiations; and <br />NOW, THEREFORE, BE IT RESOLVED B Y THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to enter into are <br />amended contract with Johnson, Miller & Schmitz, providing for the firm to serve, in <br />addition to labor negotiator, as outside counsel in the arbitrations between the City and <br />Unions representing the Safety Forces relating to the ongoing collective bargaining <br />negotiations. <br />SECTION 2: That the said amended contract shall be in form and substance <br />satisfactory to the Director of Law and substantially in the form of the current contract <br />between the City and this law firm, with only such changes made as are necessary to <br />effectuate this legislation. The character of such changes as consistent with this <br />legislation and not substantially adverse to the City shall be evidenced conclusively by <br />the execution of the agreement by the Mayor and the approval of the agreement by the <br />Director of Law. <br />
