<br />SHARING AGREEMENT <br />between <br />CITE' O)F NORTIII OLMSTED, OI-IIO <br />and <br />OLMSTED TOWNSHIP <br />for <br />USE OF 1,000 ACU TACTICAL RADIO UNIT <br />Whereas, the City of North Olmsted and Olmsted Township have, by and through <br />their respective Fire Departments, enjoyed many years of mutual aid in the provision of <br />emergency fire and medical services, and as interoperability has been facilitated by radio <br />communications via shared UHF frequency; and <br />Whereas, Olmsted Township Fire Department is prepared to upgrade to 800 <br />megahertz radio frequency system, which improvements will enhance capacity and <br />increase fire safety and emergency response by said Fire Department; and <br />Whereas, the City of North Olmsted Fire Department has acquired through federal <br />grant monies and proposes to increase the utilization of a ACU 1000 tactical radio unit, <br />which equipment may be transferred to and maintained by Olmsted Township Fire <br />Department for incorporation into its communication upgrade and facilitate <br />interoperability; and <br />Whereas, the purpose of this Agreement is to transfer possession, utilization and <br />maintenance cost of ACU 1000 tactical radio unit from North Olmsted to Olmsted <br />Township for the purpose of fire and emergency radio communications between said <br />governments; and <br />Now, therefore, the City of North Olmsted ("City") and Olmsted Township <br />("Township"), by and through their respective elective officials and governing bodies, <br />mutually agree to the following provisions at North Olmsted, Ohio, effective January 1, <br />2009: <br />l . The City hereby agrees to transfer possession and utilization of a ACU 1000 tactical <br />radio switch unit (ACU) to the Township on an "As Is" basis, for incorporation into <br />the Township Fire Department radio communications systems. Upon termination, the <br />Township shall promptly transfer custody of ACU to the City. <br />2. The City and Township agree that any and all costs associated with installation and <br />ongoing maintenance or necessary repair of the ACU shall be paid by Township. <br />3. The ACU shall remain operational and deployed for radio communication between <br />the City and Township, for fire safety and emergency purposes, including but not <br />limited to maintenance of shared radio frequency between respective Fire <br />Departments. <br />
