~... <br />.~*""~ <br />r <br />~.~~ ~. ~...,. ~ EXHIgiT <br />`"" <br />~_ <br />~.~`'~'~ <br />FEDERAL COMMUNITY' SERVICE LEARI~TING PROGRAM AGREEMENT <br />This Agreement is entered into by and between the Student Employment Office of Cleveland State University, hereinafter <br />referred to as the_"University", and <br />located at <br />hereinafter known as <br />the "Agency", and being a federal, state, or local public agency or political subdivision, or private, non-profit organization. <br />WITNESSETH: <br />VVIIEREAS, the University is operating a Federal Community Service Learning Program (FCSLP) under the provisions of 42 <br />U.S.C. 27~6a and applicable regulations; and WHEREAS, the Agency desires to utilize the services of one or more students <br />participating in the Program. NOW, THEREFORE, it is hereby agreed as follows: <br />1. The Agency shall provide to the Student Employment Office for review and approval a written job description of each <br />position for which services may be sought. Students shall be assigned only to jobs approved by the University. Each job must be <br />posted on the University's student employment job posting site. <br />2. The number of students to be placed with the Agency and the hourly rate(s) of pay shall be as mutually agreed between <br />the Agency and the University. The Agency agrees to notify the Student Employment Office and confirm the eligibility of each <br />student employee under this Program prior to beginning that student's work assignment under this Program. If eligible and based <br />on availability of funding, the University will award Federal Work Study funds to a student employee once notified by the Agency <br />that an offer of employment is being made. <br />3. The Agency has the right to control and direct the services of students, not only as to the result to be accomplished but <br />also as to the means by which the result is to be accomplished. The Agency's employment policies shall apply to the extent such <br />policies are consistent with this Agreement, and the Agency agrees to furnish adequate, qualified supervision of all students who <br />are placed there. <br />4. Within thirty (30) days, the Agency shall provide in a timely and regular manner a detailed Record of Hours Worked <br />and a Billing Statement that shows a certification of hours reported, signed by the Supervisor. This shall include the name of each <br />student, each student's hourly wage rate; the number of hours each student worked for the applicable period; and the total of such <br />earnings during the pay period. Also required is a copy of proof of payment to the student, such as a payroll transaction register or <br />a cashed paycheck. The Agency acknowledges that billings more than thirty days overdue will not be reimbursed. Final billing <br />for this contract period must be received by the Student Employment Office not later than thirty days after the end of the contract. <br />5. The University agrees to reimburse the Agency for wages earned under this Agreement, within thirty days of receipt of <br />each verified billing from the Agency an amount equal to the amount being reimbursed to the University by the Federal <br />Government for individual participants. The Student Employment Office has the right to review prospective work assignments to determine appropriateness of <br />assigmnent, determine whether individual students meet the eligibility requirements, refer students to the Agency, and perform site <br />visits as may be practical. <br />7. The Agency acknowledges that students must maintain eligibility to work in this program, that students may not work <br />and the Agency will not be reimbursed for any hours worked by students during class times for which students are registered, and <br />
