BY: Council Members Barker, Jones, Kearney, Mahoney, Orlowski, and Brossard A RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO SOLICIT STATEMENTS OF QUALIFICATIONS ("SOQs ") FROM QUALIFIED ATTORNEYS AND LAW FIRMS TO PRO VIDE PROFESSIONAL SERVICES AS THE CITY'S BOND COUNSEL; AND FURTHER AUTHORIZING THE MAYOR, SUBJECT TO APPROVAL OF THE BOARD OF CONTROL, TO ENTER INTO A PERSONAL SERVICES CONTRACT WITH THE ATTORNEY OR FIRM SELECTED, AS AMENDED. WHEREAS, this Council, on February 19, 2009, based upon the recommendation of the Mayor and Director of Finance, adopted Ordinance No. 2009- 17, dispensing with the RFQ process otherwise required by Chapter 112 of the Codified Ordinances of the City of North Olmsted, and authorizing the Mayor to retain the services of and enter into a contract with Squire, Sanders & Dempsey L.L.P. to serve as bond counsel for the City of North Olmsted in the matter of the City's 2009 General Obligation Bond Anticipation Note financing; and WHEREAS, it is the desire of this Council, in order to protect the City's taxpayer dollars and to insure that the City Council receives the most qualified bond counsel services available and at a price that is reasonable, to retain bond counsel services for the year 2010 and thereafter through utilization of the RFQ process provided for in Chapter 112 of the North Olmsted Codified Ordinances; and WHEREAS, it is accordingly further the desire of this Council to authorize the Director of Finance, acting pursuant to the provisions of said Chapter 112 of the Codified Ordinances of the City of North Olmsted, to conduct such RFQ process on behalf of the City Council, and for the Mayor, following approval of the Board of Control, to enter into a contract for bond counsel services with the attorney or law firm selected in the RFQ process; and NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Director of Finance be and she hereby is authorized to solicit Statements of Qualifications ("SOQs") from attorneys and law firms qualified to serve as the City's bond counsel for the years 2010 and 2011, or, in her discretion, for the years 2010 and 2011, with an option for the years 2012 and 2013 also, in accordance with a Request for Qualifications ("RFQ") to be prepared and advertised by the Director of Finance.
