<br />.~ <br />WHEREAS, pursuant to a reorganization of the CITY's Division of Engineering, <br />authorized by CITY Council pursuant to Ordinance No. 2007-156, it is now necessary for <br />the CITY to obtain additional engineering services over and above those obtained in its <br />original contract, as extended from time to time, with CITY ENGINEER and <br />CONSULTING ENGINEER; and <br />WHEREAS, the CITY Council, pursuant to Ordinance No. 2007-157, and in <br />recognition of the reorganization of the Division of Engineering as authorized by <br />Ordinance No. 2007-15&, has authorized the Mayor of the CITY to enter into -and execute <br />a new contract with the CONSULTING ENGINEER, CITY ENGINEER and the <br />ASSISTANT CITY ENGINEER, extending and amending the previous contract with the <br />CONSULTING ENGINEER and CITY ENGINEER; and <br />NOW THEREFORE, the CITY, CITY ENGINEER, ASSISTANT CITY <br />ENGINEER, and CONSULTING ENGINEER, each acknowledging the sufficiency of <br />the consideration contained in the terms and conditions of the Agreement, agree as <br />follows: <br />SECTION 1. BASIC SERVICES. <br />I.1 The SERVICES required to be performed by the CITY ENGINEER, and <br />ASSISTANT CITY ENGINEER under this Agreement shall be the basic services <br />provided to the CITY. <br />1.2 For providing the basic services, the CITY ENGINEER shall receive a <br />retaining fee in the sum of Thirty Six 'Thousand Dollars {$36,000.00) per annum. The <br />ASSISTANT CITY ENGINEER shall receive a retaining fee in the seam of Eighteen <br />Thousand Dollars {$18,000.00) per annum. The retaining fees shall be paid on a <br />biweekly basis commencing upon the effective date of this Agreement, and the amounts <br />shall be subject to the contribution by the CITY and the CITY ENGINEER and <br />ASSISTANT CITY ENGINEER, respectively, to PERS. In consideration of said <br />retaining fees, CITY ENGINEER and ASSISTANT CITY ENGINEER shall provide aII <br />of the following basic services: <br />{a) Give information and advice, as needed and as directed and/or authorized <br />by the Director of Public Service, to Council, the Mayor, Directors and <br />z <br />
