? i • <br />AGREEMENT TO PURCHASE REAL PROPERTY <br />This Agreement, entered into at North Olmsted, Ohio this day of _Ck1b)Dg,?-, 2001 <br />by and between the City of North Olmsted, 5200 Dover Center Road, North Olmsted, Ohio <br />44070 (hereinafter, the "Purchaser"), and Retail Today Limited, cJo Petros Development Corp., <br />10474 Broadview Road, Broadview Heights, Ohio 44147 (hereinafter the "Seller") <br />WHEREAS, it is the desire of the Seller to sell, and the Purchaser to purchase, a certain <br />portion of the real property located immediately to the south of the CVS drugstore property on <br />Clague Road, North Olmsted, Ohio, Permanent Parcel #237-9-5, which shall become part of the <br />right-of-way in connection with the proposed widening of Clague Road; and <br />WHEREAS, the purchase of this property has been authorized by North Olmsted <br />Ordinance Number 2001-_; <br />NOW THEREFORE, on the basis of the foregoing premise, for the consideration <br />hereinafter recited, and on the conditions and terms which follow, the parties agree as follows: <br />ITEM ONE: Purchase and Sale of Real Prooertv <br />Subject to the terms and conditions of this Agreement, the Seller agrees to sell and the <br />Purchaser agrees to purchase all of the Seller's right, title and interest in the above-mentioned part <br />of the real property, which is located immediately to the south of the CVS drugstore property on <br />Clague Road, North Olmsted, Ohio. The real property being sold is an irregularly shaped, <br />variable width piece of land along Clague Road, consisting of a total of 1767.511 square feet, and <br />legally described in attached Exhibit "A," and depicted oii the plat marked as Exhibit "B." In <br />addition, Seller agrees that it shall fully cooperate with the City and do all acts necessary in the
