' + <br />splitting off of said piece of land from its property immediately to the south of the CVS drugstore <br />property on Clague Road, including, but not limited to, signing the necessary subdivision plat or <br />plats. <br />I1'EM TWO: Grant of Right of Entrv Construction Easement <br />As a term and condition of this Agreement, Seller further agrees to grant Purchaser a <br />temporary Right-of-Entry construction Easement in substantially the form as the attached <br />Easement Agreement marked as Exhibit "C" and consisting of a one-page agreement and a one- <br />page map. <br />ITEM THREE: Purchase Price <br />The purchase price for the real property described in ITEM ONE and the easement <br />granted in ITEM TWO shall be TWENTY-TWO THOUSAND EIGHT HUNDRED FIFTy <br />DOLLARS ($22,850.00). <br />ITEM FOUR: Pavment of the Purchase Price <br />The purchase price described in ITEM THREE shall be paid as follows: <br />(a) At the time of signing -$22,850.00. <br />ITEM FIVE: Evidence of Title <br />Seller shall convey good and marketable title to said property by furnishing Purchaser with <br />a general wairanty deed to said property. Said deed shall release dower rights, if any, and shall <br />state that said property is being conveyed free and clear of all liens and encumbrances whatsoever, <br />except (a) restrictions of record and any conditions, reservations and easements created in <br />.? <br />conjunction with such restrictions; (b) zoning ordinances, if any, and (c) taxes and assessments, <br />both general and special, for the current half of the tauable year and thereafter. <br />2
