Seller shall pay all costs <br />associated with the transaction. All documents and funds necessary for the completion of this <br />Agreement shall be exchanged by and between the parties at the signing of this Agreement. <br />Possession shall be given to Purchaser upon title transfer. In addition, Purchaser's easement upon <br />Seller's property shall become effective upon tide transfer. <br />11'EM SEVEN: No Prorations. Etc. <br />General taxes, special assessments that are a lien, and annual maintenance charges, <br />municipal and county, if any, shall not be prorated. <br />11'EM EIGHT: Binding Agreement <br />This Agreement shall be binding upon and inure to the benefit of Seller and Purchaser, and <br />their respective heirs, executors, administrators and assigns. This Agreement contains all of the <br />terms and conditions of this transaction upon which Seller and Purchaser have agreed. <br />Purchaser represents and states that it has read this Agreement and fully understand its <br />entire contents; that it has inspected the subject real property to its complete satisfaction and is <br />entering into this Agreemern having full knowledge of the complete physical condition of said <br />property; and that Seller has made no written or oral representations to it about the physical <br />condition of the property, other than as expressly stated in this Agreement. Both parties waive <br />the requirement of the presentment of a Real Property Disclosure Statement. <br />ITEM 1VINE: Failure to Perform <br />.I <br />Seller and Purchaser agree that, should either fail to perform their obligations under this <br />Agreement, either shall be entitled to pwsue any remedy available to them at law or in equity. <br />3
