<br />? - <br />AGREEMENT TO PURCHASE REAL PROPERTY <br />This Ageement, entered into at North Olmsted, Ohio this 22 day of JQ2.IMO,?L 2001 <br />by and between the City of North Olmsted, 5200 Dover Center Road, North Olmsted, Ohio <br />44070 (hereinafter, the "Purchaser"), and North Olmsted-Gettysburg, c/o Petros Development <br />Corp., 10474 Broadview Road, Broadview Heights, Ohio 44147 (hereinafter the "Seller"). <br />WHEREAS, it is the desire of the Seller to sell, and the Purchaser to purchase, a certain <br />portion of the real property located at 23345 Lorain Road, North Olmsted, Ohio, Permanent <br />Parcel #237-9-1, which shall become part of the right-of-way in connection with the proposed <br />widening of Clague Road; and <br />WHEREAS, the pwchase of this property has been authorized by North Olmsted <br />Ordinance Number 2001-_; <br />NOW THEREFORE, on the basis of the foregoing premise, for the consideration <br />hereinafter recited, and on the conditions and terms which follow, the parties agree as follows: <br />I1'EM ONE: Purchase and Sale of Real Prouertv <br />Subject to the terms and conditions of this Agreement, the Seller agrees to sell and the <br />Purchaser agrees to purchase all of the Seller's right, title and interest in the above-mentioned part <br />of the real property, which is located at 23345 Lorain Road, North Olmsted, Ohio. The real <br />property being sold is a somewhat rectangular-shaped piece of property along Clague Road, <br />consisting of 438.524 square feet, and legally described in attached Exhibit "A," and depicted on <br />the plat marked as Exhibit "B." In addition, Seller agreed that it shall fully cooperate with the <br />City and do all acts necessary in the splitting off of said piece of land from its property at 23345
