. . _ ... . . . .,.. .a..e _.c?.}?,.x_:,...., _.. ..._ ...., ... . . .. . <br />Iw <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2001-146 <br />BY: MAYOR MUSIAL AND THE ENTIRE CITY COUNCIL. <br />AN ORDINANCE CREATING NEW SECTION 161.08 OF THE ADMINISTRATIVE <br />CODE, ENTITLED "MILITARY LEAVE BENEFITS," IN ORDER TO PROVIDE <br />PERMANENT CITY EMPLOYEES CALLED UP TO MILITARY DUTY PURSUANT <br />TO EXECUTIVE ORDER OF THE PRESIDENT OR ACT OF CONGRESS WITH <br />GREATER BENEFITS THAN THAT WHICH IS PROVIDED PURSUANT TO <br />SECTION 5923.05 OF THE OHIO REVISED CODE, AND DECLARING AN <br />EMERGENCY. <br />WHEREA.S, it is the desire of this Council to provide that permanent city employees who are <br />called to active military duty pursuant to an executive order issued by the President of the United <br />States or an act of Congress suffer no loss of pay or benefits for the period or periods of time they <br />are called to active duty pursuant to such order or act, which such period or periods sha11 not exceed <br />a total of one year of active duty time; and <br />WHEREAS, it is the desire of this Council that this Ordinance be construed to provide more <br />benefits to permanent city employees than that which is provided by R.C. Section 5923.05; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That there be and is hereby created new Section 161.08 of the Administrative <br />Code, entitled `2Vlilitary Leave Benefits," which as created sha11 read in its entirety as follows: <br />161.08. MILITARY LEAVE BENEFITS. <br />(A)(1) Permanent public employees of the City, as defined in Section 5903.01 of the <br />Revised Code, who are members of the Ohio organized militia, or members of other reserve <br />components of the armed forces of the United States, including the Ohio National Guard, are <br />entitled to leave of absence from their respective City positions without loss of pay or benefits for <br />the time they are performing service in the uniformed services because of an executive order <br />issued by the president of the United States or an act of Congress for a period not to exceed one <br />year. `Vithout loss of pay' means that the City shall pay to any such employee, in accordance, to <br />the extent practicable, with the City's regular payment schedule, the difference between the pay <br />the employee would be receiving as a City employee had he not have been called to active duty, <br />and the pay he is receiving as a member of the Ohio organized militia or other reserve components <br />of the armed forces of the United States, including the Ohio National Guard. `Benefits" means <br />only those benefits thax are provided to such employees by ordinance of the City or collective <br />bargaining agreement.
