<br />9. Obtain approval from the City's Recreation Commission prior to making changes, <br />alterations, improvements, or additions to the second (Znd) floor gym area. All such <br />improvements or alterations are fixtures, and shall remain property of the City. <br />10. Insure that all areas of the gym are inspected before use and immediately provide <br />' written notification of any unsafe conditions to the City. <br />11. Rent space outside the Recreation Complex if necessary for instruction, at <br />Instructor's cost. Students instructed away from the Recreation Complex must still <br />be properly registered with the City. <br />12. Assume all responsibility for costs, liability, insurance, and supervision of all events <br />held outside the Recreation Complex, including meets, other competitive aetivities, <br />and travel to and from such activities. <br />The City shall: <br />1. Make the second (2nd) floor gym area available for Instructor's programs during <br />hours approved by The City. The City will be entirely responsible for maintenance <br />of the facility, and necessary improvements to the facility. <br />2. Assist in advertising programs conducted by Instructor, including providing space in <br />seasonal brochures published by the City for publicity of Instructor's progams. <br />3. Register students in classes conducted by Instructor, and collect fees charged by <br />Instructor, provided that such programs and their costs are previously approved by <br />the City. <br />4. Provide janitorial equipment and cleaning of gym area at least twice per week, and <br />as necessary. <br />5. Provide reasonable access to office equipment and reasonable amounts of office <br />supplies. <br />Section III <br />Duration of Employment <br />The term of this agreement shall be For a period commencing on September 1, 1999, and <br />terminating on August 31, 2002, subject, however, to prior termination as provided below. The <br />modifications to the original contract, as set forth herein, shall be effective September 4, 2001. <br />Section IV <br />3
