<br /> <br />?., .,.. <br />(c) For exhibitions and ice shows, the City agrees to pay Contractor the following amounts: <br />For exhibitions - Twenty-five percent (25°/a) of gross admissions. <br />For ice shows - Twenty-five percerrt <br />(25%) of participation fee (if one is charged) and <br />twenty-five percent (25%) of gross admissions. <br />Payment sha11 be made to Contractor no later than ten (10) business days following the conclusion <br />of the event. The Contractor sha11 determine the admission fees to all exhibitions and ice shows, <br />subject to the prior consent ofthe City which shall not be unreasonably withheld. <br />(d) Contractor shall be entitled, at reasonable times and upon request, review appropriate <br />financial records of the Recreation Complex in order to confirm that his compensation amounts, <br />pursuant to this Contract, have been properly calculated by the City. <br />Section IV <br />Duration of Contract <br />The term of this Contract shall be for a period commencing on February 26, 2001, and <br />tenninating on June 30, 2002, subject, however, to prior terrnination as provided below. This <br />Contract may be renewed, subject to approval ofthe City Council. <br />Section V <br />Contract Termination Events <br />Notwithstanding anything in this Contract to the contrary, either the City of Contractor may <br />terminate this Corrtract, if good cause exists, upon providing sixty (60) days advance written notice <br />to the other party. Either the City or Contractor may also terminate this Contract, upon thirty (30) <br />da.ys advance written notice to the other, in the evern that, during a term of this Comract, Corrtractor <br />becomes permanerrtly disabled, as the term permanently disabled is defined below, and is unable to <br />perform the personal services required of him under this Contract. Corrtractor shall be deemed to be <br />permanently disa.bled it during any year of the term of this Contract, because of ill health, physical <br />or mental disability, he shall have been continuously unable or otherwise sha11 have failed to <br />substantially perform his duties under this Contract for thirty (30) consecutive days, or for a total of <br />sixty (60) days during any year of a term of this Cornract, whether consecutive or not. For the <br />purposes of this Contract, the term "any year of a term of this Contract" is defined to mean any <br />period of 12 calendar months occurring during a term or terms of this Contract. <br />4
