We aze extzemely pleased to quote you oza these services, however after reviewing the plan for the cxisting actuated flashing signal, we have some grave concerns regarding the tiability issues at this aocation. Clwc zeview has detexxnined that the existing crossiuag is made from the Clague Park Dxive across ta a private drive ozz the east side of the street. We find this to be a vezy dangerous situat.ion, where pedestrians may be struck by motorasts backing from the private drive. Ow extensive experience in crosswalk design has found that the City af Noztta Oimsted may be liable fox the aceident pDtential created by this situation. Cxossings should be made to a concrete aanding pad sep$rated from the existing drive apron wiith fula access izi coznpliance with the Americans with Disabilities Act requirements. We are a}so cvncezned that if we were to provide design services for the in pavement warning system, we may be an accessory to any liabiaity claim xf an accic3ent were to happen at this location. We feel that it is imperative tb,at the Cxry of North Olmsted address this condition and make plans to zecxxove the k?azard. If the City agrees to correct the situation, either imrnediately or with the installation of the roadway waming system, we would provide design services for this project. All work shal2 be performed as autlined 'an your letter dated September l 7, 200 ). A,1l design shall be done using AutoCAD version 12 containing a file for each final design drawxng prepared.
