CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2001-113 <br />BY: COUNCIL MEMBER PAUL MII,LER <br />AN ORDINANCE AMENDING SECTION 149. 02 OF THE ADMINISTItATIVE CODE <br />IN ORDER TO ESTABLISHA CLEAR PROCEDURE FOR NOTICE TO BE GIVEN <br />TO CONDOMINIUM PROPERTY OWNERS AFFECTED BY PROPOSED <br />DEIrELOPMENTS. <br />WHEREAS, cunent Section 149.02 of the Administrative Code provides for notice to be <br />given to property owners who are affected by proposed developments; and <br />WHEREAS, the cunent notification procedure in Section 149.02 does not specifically <br />provide for an effective method of notification for property owners residing in condominium <br />developments; and <br />WHEREAS, it is the desire of this Council to amend Section 149.02 of the Administrative <br />Code in order to establish a clear notification procedure to employ in the instance of proposed <br />developments which affect condominium property owners; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAH4GA AND STATE OF OHIO: <br />SECTION 1: That Section 149.02 of the Administrative Code, entitled "Notice of <br />Meetings," which presently reads as follows: <br />"149.02 NOTICE OF MEETINGS. <br />(a) The secretary of the Planning Commission shall be required to send notification of Planning <br />Commission meetings giving the time, date and subject matter of the meeting to the independent <br />record title holder of property affected by any proposed subdivision or development. <br />(b) For the purposes of this section those interested parties affected by any subdivision or <br />development shall be as follows: <br />(1) Those on the same side of the street which abut the premises involved; <br />(2) Those across the street immediately opposite the premises involved; <br />(3) Any other premises abutting the premises involved; and <br />(4) Such other premises as may be ordered to be notified by rule or regulation of the <br />Commission or by its special order. <br />(c) The notice specified in subsection (a) hereof shall be by regular first class mail postage <br />prepaid, mailed at least five days prior to the date of such meeting. <br />For purposes of this section "independent record title holder" means a person, who as disclosed
