Nothing herein provided shall be construed as limiting the power of the <br />Commission from enlarging on such notice." <br />shall be amended, and, as amended, shall read in its entirety as follows: <br />"149.02 NOTICE OF MEETINGS. <br />(a) The secretary of the Planning Commission shall be required to send notification of Planning <br />Commission meetings giving the time, date and subject matter of the meeting to the independent <br />record title holder of property affected by any proposed subdivision or development. <br />For the purposes of this section those interested parties affected by any subdivision or <br />development shall be as follows: <br />(1) Those on the same side of the street which abut the premises involved; <br />(2) Those across the street immediately opposite the premises involved; <br />(3) Any other premises abutting the premises involved; and <br />(4) Such other premises as may be ordered to be notified by rule or regulation of the <br />Commission or by its special order. <br />(b) The notice specified in subsection (a) hereof shall be by regulaz first class mail postage <br />prepaid, mailed at least five days prior to the date of such meeting. <br />(c) For pwposes of this sectian "independent record title holder," except as otherwise specifically <br />provided herein for condominium property, means a person, who as disclosed by the records of the <br />Auditar of the County, is the owner at any date within sixty days of the date of such notice. For <br />condomunium property, "independent recard title holder" means the candominium homeowners <br />association for the condominium properiy, as disclosed by the records of the Auditor or Recorder of <br />the Caunty. Notice to a candominiurn homeowners assoeiation shall be deemed sufficient if it is <br />addressed to the Fresident and Seeretary of the assaciation and mailed ta the address for the <br />assQCiation listed in the records of the Auditor or Recorder of the County. Nothing herein provided <br />shall be construeci as limiting the power of the Gommission from enlarging on sueh notice." <br />SECTION 2: That the operation of any Ordinance, or part of any Ordinance in conflict or <br />inconsistent with any provision of this Ordinance is, to the extent of any such conflict or <br />inconsistency, repealed. <br />SECTION 3: That this Ordinance sha11 take effect and be in force from and after the earliest <br />period allowed by iaw. <br />2
