959.01. Notice to Residents. <br />Whenever legislation is proposed providing for the sale of City-owned surplus real property, <br />which abuts any real property zoned for residential use, the Clerk of Council shall give notice to <br />every abutting property owner of the date and time of the Council meeting at which the legislation <br />will be first read. Such notice shall be in writing, shall be sent by certified mail (return receipt <br />requested), and shall be deposited in the U. S. mails at least ten (10) days prior to the date of the <br />Council meeting at which the legislation is proposed to be first read. For purposes of this section, <br />"abutting property owner" shall mean the owner of any residentially-zoned real property which <br />either abuts, or is directly across a public street from, the City-owned surplus real property <br />proposed to be sold. Further, for purposes of this section, the "owner" of condominium property <br />which abuts such City-owned property shall be deemed to be the President and Secretary of the <br />condominium homeowners association. <br />SECTION 2: That any Ordinance, or part of any Ordinance, in conflict or inconsistent with <br />any provision of this Ordinance is, to the extent of any such conflict or inconsistency, repealed. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare of the residents <br />of the City of North Olmsted, and for the further reason that it is necessary that Ordinance <br />immediately go into effect so that residents may be immediately notified if City surplus real property <br />is proposed for sale within the next 30 days, and further provided it receives the affirmative vote of <br />two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage <br />and approval by the Mayor <br />?.. <br />PASSED: L First Reading: <br />Second Reading: ? /:S c t <br />Third Reading: <br />Committee: <br />ATTEST.• <br />I <br />'? / " p •r <br />C-'L tl..zt.-L.. <br />BARBARA L.
