MEMORANDUM OF UNDERSTANDING This Memorandum of Understanding is made this daY of 2001 between Ohio Council8, American Federation of State, County and Municip I Employees, AFL-CIO and Lacal 2681, American Federation of State, County and Municipal Employees, AFL-CIO (hereinafterjointly referred to as "Union") and the City of North Olmsted (hereinafter, "City"). The Union and the City hereby acknowledge the following; 1, The Union is certified by the Sfiate Employment Relations Board as the exclusive representative of employees of the City in the bargaining unit described in Case Number 85- VR-12-4747; and 2. The parties are signatories to a Collective Bargaining Agreement which, at Article 2, Section 1, and Appendix B, sets forth the current classifications represented by the Union in the bargaining unit; and 3. The parfiies are signatories to a Settlement Agreement in Case Number 96-REP-07- 0130, previously before the State Employment Relations Board, which provides: a) the ciassification ofi Police Secretary I(assigned to the Chief) is deemed to be inciuded in the bargaining unit; and b) the classification of the Police Secrefiary (assigned to the Administrative Police Captain) is confidential and appropriately excluded from the bargaining unit; and 4. Since the execution of the Settlement Agreement described in item 3, above, the assigned job duties of the Police Secretary (assigned to the Administrative Police Captain) and thejob duties of the Police Secretary I(assigned to the Chieo have changed significantly. The parties agree that the job duties of the Police Secretary (assigned to the Adrninistrative Police Captain) have been significantly modified so fihat the classification is no longer confidential. The parties also agree that the Secretary I(assigned to the Chieo is currentiy performing job duties which change the sfatus of the 82
