ARTICLE 13: <br />LAYOFF AND RECALL <br />SECTION 1: When a layoff is necessary due to lack of funds or lack of work, the <br />Employer shall notify the effected employees in writing at least fourteen (14) days in <br />advance of the effective date of layoff. The Empioyer, upon request from the OPBA, <br />agrees to advise the representatives of the OPBA, the impact of the layoff on <br />bargaining unit employees. <br />SECTION 2: Employees shall be laid off in accordance with their departmental <br />seniority, last hired, first laid off. <br />SECTION 3: Empioyees who are laid off shall be placed on a recall fist for a period <br />equal to fiheir length of service not to exceed thirty six (36) months. If there is a recall, <br />empfoyees who are still on the recall Iist shall be recafled in the inverse order of their lay <br />off, last laid off, first recalled. <br />SECTION 4: Notice of recafl shall be sent to the employee(s) by registered mail, with a <br />copy to the OPBA. The Employer shall be deemed to have fulfilled its obligation by <br />mailing the recall notice by registered mail, return receipt requested, to the last maifing <br />address of the employee. <br />SECTION 5: The recalled employee shall have ten (10) calendar days following the <br />date of receipt of the recall notice, to notify the Employer of the employee's intent to <br />return to work. <br />SECTION 6: Before any full-time employee may be laid off, all part-time employees will <br />be first laid off. <br />ARTICLE 14: <br />MISCELLANEOUS <br />SECTION 1: In any instance where the Employer sends an employee for a medical <br />examination for fitness of duty, the Employer shall pay the cost of the examination and <br />shall pay the employee for the time expended taking such examination. The City will <br />not be responsible for payment of Workers' Comp examinations. <br />SECTION 2: The OPBA will be allowed one (1) bulletin board for official OPBA notices. <br />12
