of birth of the child or in the case of an adopted child, a copy of the court document <br />authorizing the adoption. <br />SECTION 8: An employee shali accumulate seniority during any leave of absence. <br />Employee's on an unpaid sick leave, parental leave, or has exhausted his accumulated <br />sick leave shall not be entitled to any benefits, except hospital/surgical benefits which <br />shall continue to be provided by the Employer for a period of time not to exceed ninety <br />(90) days. During the aforementioned ninety (90) day time period, the employee shall <br />be required to pay his proportionate share of the cost as required within Article 28, of <br />the Agreement. The proportionate cost shall be paid to the Employer by the employee <br />in advance on or before the first day of the month. The Employer shall continue to pay <br />its proportionate share of the cost as required within Article 28, of the Agreement during <br />this ninety (90) day period. After ninety (90) days, the employee shall be required to pay <br />to the Empfoyer, the full cost of the cost of such hospital/surgical benefiits in advance on <br />a monthly basis, commencing on the ninety-first (91 st) day. Any empfoyee that fails to <br />pay his proportionate share or the full cost as described shall be dropped as a <br />participant from the group health plan for nonpayment, as required by this Agreement. <br />An employee that is dropped from the group health plan for non-payment shall only be <br />eiigible to participate after the conclusion of the leave and only upon his active return to <br />work. Employees shall be subject to all of the terms and conditions of the group health <br />plan. <br />ARTICLE 22: <br />INJURY LEAVE <br />SECTION 1: In the event that a full-time employee of the North Olmsted Palice <br />Department should be injured while in the line of duty due to a sudden and accidental <br />occurrence, and such injury has so incapacitated said member of the Pofice <br />Department that he is temporarily unable to work, then the Director of Public Safety, <br />after determining that said injury is work-related and is of a temporary nature, may <br />authorize ninety (90) days sick leave. If after such ninety (90) days sick leave period <br />said employee is still temporarily incapacitated, then the Director of Public Safety shall <br />recommend fio Council whether or not to continue said salary. Council shall forthwith <br />review the matter and, by majority vote, determine whether the employee shall continue <br />to receive his full salary during recuperation. <br />For the purpose of this paragraph, a sudden and accidental injury shall include <br />such incidents as an automobile accident, assault, gun shot wound and the like. It may <br />not be considered as sudden and accidental if an injury or incapacitation results from <br />lifting, slipping, tripping or falling. <br />SECTION 2: Any full-time employee of this bargaining unit who qualifies for benefits <br />under this Article shall be required to pay over to the city any amount received from the <br />Bureau of Workers Compensation as supplemental wages. <br />21
