Further, if at any time the City determines, on the basis of inedical evidence, that <br />the employee is permanently disabled and will no longer be able to carry on his duties, <br />then the City may terminate payments and insist that the employee go on a pension <br />program. <br />SECTION 3: Any employee who qualifies for the benefits under this Article shall not <br />have his accumulated sick time reduced because of a qualified accidental injury which <br />occurred while in the line of duty. <br />ARTICLE 23: <br />BEREAVEMENT LEAVE <br />SECTION 1: All employees shall be granted Bereavement Leave (not to be deducted <br />from employee's sick leave) according to the foilowing schedule: <br />a) Upon the death of an immediate family member, five (5) days; and <br />b) Upon the death of a family member, three (3) days. <br />SECTION 2: For the purposes of this Article, immediate family shall mean: Husband, <br />wife, child, parent, brother or sister of employee and parents of spouse of the <br />employee. <br />Family member shall mean: Brother or sister of spouse, grandparents, grandparents of <br />spouse, grandchild as well as any relative living in the employees house. <br />ARTICLE 24: <br />JURY DUTY LEAVE <br />SECTlON 1: An employee called for jury duty shall be granted a leave of absence for <br />the period of the jury service and will be compensated at full pay for absences <br />necessarily caused by the jury duty. <br />SECTION 2: Employees working the second, third, relief or overlap shifts, will not be <br />required to work on the day that the employee is on jury duty and these employees will <br />be compensated as provided in Section 1. <br />22
