Ordinance No. 2001-74 <br />Page 2 <br />SEC. 3. PRIMARY ELECTIONS. <br />Candidates for all offices to be voted for at any municipal elections under the provisions of <br />this Charter shall be nominated at a non-partisan primary election to be held in odd numbered years <br />on a date and at a time provided for by the general laws of the State of Ohio governing municipalities. <br />SEC. 4. DESIGNATION OF CANDIDATES. <br />The number of candidates for the office of Mayor, President of Council, Director of Finance, <br />Director of Law, and Council-by-Ward at any regular municipal election in the City shall be the two <br />(Z) candidates on the primary election ballot receiving the highest number of votes at the primary <br />election. The number of candidates for the office of Council-at-Large at any regular municipal <br />election in the City shall be the six (6) candidates on the primary election ballot receiving the highest <br />number ofvotes at the primary election. <br />In case there shall not be more than two (2) persons who shall have filed petitions for the <br />office of Mayor, President of Council, Director of Finance, Director of Law, and Council-by-Ward, <br />as provided for in this Charter, then said persons shall be the candidates at the regular municipal <br />election and the primary election for the office not exceeding two (2) persons shall not be held. In <br />the case there shall not be more than six (6) persons who shall have filed petitions for the office of <br />Council-at-Large as provided for in the Charter, said persons shall be the candidates at the regular <br />municipal election and the primary election for Cou.ncil-at-Large shall not be held. <br />Anyone who has not properly filed a petition for the appropriate primary election as provided <br />for in this Charter, shall be ineligible as a designated candidate in the regular municipal election. <br />SEC. 5. GENERAL PROVISIONS. <br />After each recurring Federal Census and within three months after the issuance of the <br />proclamation by the Secretary of State, certifying the population of the City, or when there is annexed <br />thereto, any territory, the Council shall redistrict the City into four (4) wards, if necessary, so as to <br />have each ward as nearly equal in population as practicable and which shall be bounded by county <br />lines, streets, alleys, avenues, public grou.nds, ca.nals, water courses, municipal corporate lines, or <br />center lines of platted streets in said ward. <br />If the Council fails to make such subdivisions within the time required, it shall then be made <br />by the Director of Public Service. <br />Where no special provision is made in this Charter governing general, primary, or special <br />election, registration and the conduct of such elections, the provisions of the generallaw of the State <br />of Ohio shall control. <br />SECTION 2. If the foregoing proposal receives the affinnative vote of a majority of <br />the electors voting thereon, then the amended Article IX shall be effective as of the earliest date <br />provided by law. <br />SECTION 3.
