CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2001 - 70 <br />BY: Mayor Norman Musial <br />AN ORDINANCE ACCEPTING A PERMANENT STORM <br />SEWER EASEMENT LOCATED ON PROPERTY OWNED BY <br />PAUL E. AND TERESA A. GRZYBOWSKI AND DESIGNATED <br />AS PERMANENT PARCEL NO. 235-17-045 ON THE <br />CUYAHOGA COUNTY MAPS AND RECORDS, IN <br />CONNECTION WITH THE REVERE DRIVE CULVERT <br />EXTENSION, AND DECLARING AN EMERGENCY. <br />WHEREAS, the City is in the process of improving the City Storm Sewer <br />System by constructing and extending the Revere Drive culvert; and <br />WHEREAS, in order to construct and install said new line, it is necessary that <br />the City obtain easements from several property owners, whose properties lie on the east <br />side of Revere Drive: and <br />WHEREAS, this Council desires to fairly compensate the owners of the property <br />known as Permanent Parcel No. 235-17-045 in the manner stated in the easement, and <br />obtain from said owner a 12-foot permanent easement addition to the existing 20-foot <br />easement, for storm sewer easement purposes, in order to construct and install an <br />extension along the north property line of said property; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE <br />CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF <br />OHIO: <br />SECTION 1: That the Mayor is hereby authorized and directed to accept, on <br />behalf of the City of North Olmsted, a permanent storm sewer easement from Paul E. and <br />Teresa A. Grzybowski the owners of certain real property located on the east side of <br />Revere Drive, south of Butternut Ridge Road, and known as Permanent Parcel No. 235- <br />17-045. A copy of said easement, which the Mayor is authorized and directed to accept <br />on behalf of the City, is attached hereto as Exhibit C, and made a part hereof as though <br />fully rewritten herein.
