Ordinance 2001 - 70 <br />Page 2 of 2 <br />SECTION 2: That the Director of Public Service is authorized and directed to (1) <br />removal of two large trees located between the house and the creek, a 40-inch diameter <br />twin Pin Oak and a 24-inch diameter Silver Maple; (2) landscaping of disturbed area upon <br />completion of the sewer installation project that will consists of the placement of two (2) <br />inches of topsoil, meeting the requirements of Item 653 in the Ohio Department of <br />Transportation (ODOT) specifications, and sodded (unless the seed is requested in writing <br />by the Grantors) in accordance with Item 660 in the ODOT specifications; and (3) <br />addressing any potential for water back-up from the mouth of the drainage pipe to be <br />installed in the subject project by completing a related project which proposes to lower the <br />height of the dam at Springvale Lake, all as compensation for the granting of the said <br />easement. Further the Engineer of the City of North Olmsted is hereby directed to cause <br />said easement to be recorded in the office of the Cuyahoga County Recorder. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public peace, property, health and safety <br />of the City, and far the further reason that this legislation must take effect immediately so <br />that the City may act quickly to improve drainage in the area, and further provided that it <br />receives the affirmative vote of two-thirds of all members of this Council, it shall take <br />effect and be in force immediately upon its passage and approval by the Mayor. <br />,. <br />,.. <br />PASSED.•'?-''?. ?J c v/ <br />A7EST: <br />? <br />' Barbara L.
