The building is to be not less than 6,000 square feet and include main- <br />tenance offices, maintenance area, restrooms and a storage area. <br />5. Other considerations: The City is currently in the process of obtaining aerial photo- <br />graphs of the golf course with topographic information. This information should be <br />avaiIable on disk prior to the start of work under the scope of work intended in this <br />design contract. Various hardcopy plans are currently avaiIable of existing conditions <br />at 5prinwale in the Engineering Department. A portion of the site is within a flood <br />plain, which must be censidered, particularly in the design of the maintenance <br />building and pu.mp house. <br />The Proposal shall include the follawing items in tlle Scope of Services: <br />l. General Canditions: <br />(a) All construction documents shall bear the seai af a design professional registered <br />in the state of Ohio (e.g:, Iandscape architect, architect, engineer or surveyor, as <br />reqtzired by law or regulation for the type of document). <br />(b) Work shall not be subcontracted without prior consent of ttle City in writing. <br />(c) Additional billable services shall not be perfonmed without prior consent of the <br />City in writing. <br />(d) Key personnel to perform services shall be listed in the proposal. <br />(e) The collsultant sliall indemnify and hold the City harmless from all losses and <br />daanages resulting from the Consultant's failure to meet the standard of care for <br />services at the level customaiy for competent and prudent deszgn professionals <br />performing such services. The Consultant shall be responsible for tlie professional <br />quality, techiucal accurac_y, timely campletion, and coordination of all services. <br />( fl The scope of services may iae amended by mutual agreement. <br />(g) If a dispute arises between the Consultant and the City regarding the contract f0r <br />services, the City and the consultant sha11 negotiate in an attempt to resolve the <br />dispute. Should negotiations be unsuccessful, a mutually acceptable tlurd party <br />may be engaged to mediate the dispute, with expenses equally shared beiween the <br />City and the Consultant. <br />(h) All communications during tlie project by the consultant to the City shall be <br />directed to the office of the City Engineer or SenJice Director.
