(1) That other than Sellers or their heirs, there aze no parties in possession of any part <br />of said property as lessees, tenants at sufferance, or trespassers; <br />(2) To the best of Sellers' knowledge Sellers have complied with all applicable laws, <br />ordinances, regulations, statutes, rules, and restrictions relating to said property, or any part <br />thereof; and <br />ARTICLE 4. BREACH <br />By Sellers <br />4.01 Should Sellers default on the full and timely performance of any obligation under <br />the terms of this Agreement for any reason other than Buyer's default, Buyer may: <br />(1) Enforce specific performance of this Agreement; or <br />(2) Request that all funds paid by Buyer be forthwith returned to Buyer, and/or bring <br />suit for damages against the Sellers. <br />By Buyer <br />4.02 Should Buyer fail to consummate the purchase of said property, the conditions to <br />Buyer's obligations as set forth above in this Agreement having been satisfied and Buyer being in <br />default, and Sellers not being in default hereunder, Sellers may: <br />(1) Bring suit for damages against Buyer; or <br />(2) Rescind the transaction. <br />ARTICLE 5. MISCELLANEOUS <br />Salvage Rights <br />5.01 Buyer agrees that Sellers shall have exclusive salvage rights to the buildings on the <br />property, together with any and all decks, sheds, playhouses, etc. and all tangible personal <br />property and fixtures located within any building on the property.
