must be exercised, if at all, and all salvaged property must be removed frorti the premises, upon <br />the termination of any tenancy rights indicated in the lease attached hereto or the vacating of the <br />property prior thereto. Said salvage rights do not include the right to remove trees or shrubs from <br />the land but does include landscape features such as dmbers and stone. Any such conduct is <br />specifically prohibited. <br />Buyer to Purchase Property "as is" <br />5.02 Except as otherwise specified herein, Buyer acknowledges that said property is being <br />purchased for purposes of the construction of a new library building. All structures will be <br />removed from the property. Consequently, the City waives the requirement of a Disclosure <br />Statement and agrees to take the property in an "as is" condition. <br />Assignment of Agreement <br />5.03 This Agreement sha11 be binding on the respective heirs, executors, administrators, <br />successors, and to the extent assignable, on the assigns or nominees of the parties hereto. On <br />delivery to Sellers of an instrument in writing whereby the assignee of the Buyer assumes all of <br />the provisions of this Agreement to be performed by Buyer, then, in that event, Buyer sha11 be <br />released and discharged of all further liability hereunder. <br />Environmental Assessment <br />5.04 This agreement is contingent upon an environmental assessment to be conducted at <br />Buyer's expense, prior to closing, disclosing no violadons of any state or federal environmental <br />law or regulations; Sellers shall provide to Buyer any and all prior environmental reports in <br />Sellers' possession. Buyer sha11 be responsible for all costs of obtaining governmental approvals. <br />Rea1 Estate Broker/Agent <br />5.05 The parties acknowledge that the Sellers have not been represented by any realtor. <br />5
