Ordinance No. 2001-05 <br />Page 3 <br />177.03 APPLICATIONS; REVIEW BY MAYOR'S DESIGNEE. <br />(a) Community organizations desiring to announce community events shall make <br />application to City in writing, on a form prepared by the City. The Mayor's <br />Administrative Assistant or designee shall be the City official responsible for: <br />(1) receiving and acting upon applications for access to the nonpublic forum; <br />(2) determining the maximum number of space, in characters, available for <br />messages on banners; and <br />(3) authoring written opinions whenever an application is denied, explaining the <br />grounds for denial. <br />(b) Applications must be completed and signed no later than thirty (30) days prior to <br />the time the applicant requests that the announcement be made. <br />(c) Applications shall contain all information requested by the form adopted by the <br />City, including but not limited to the date announcement is requested and the name and <br />address of the community organization representative responsible for submitting the <br />application and supplying any additional information necessary to the processing of the <br />application. <br />(d) Applications must conform to the regulations of this Chapter in all particularities. <br />If the City's agent, upon review of the application, discovers any irregularity or defect <br />therein, the application shall be denied for failure to conform to these regulations. <br />(e) Applications shall be acted upon by the Mayor's Administrative Assistant or <br />designee, in writing, within ten (10) working days following the date of filing of the <br />application. Applications shall be routinely granted, and may not be denied by the <br />Mayor's Administrative Assistant or designee, unless the application, or the proposed <br />announcement, fails to conform to at least one express provision of this Chapter. <br />Decisions denying an application shall be mailed to the applicant by certified mail, return <br />receipt requested. No application shall be denied unless the reason for denial has first <br />been reviewed by the Director of Law. <br />177.04 CONTENT LIMITATIONS. <br />The City is establishing a nonpublic forum in the airspace above the City right-of-way at <br />the location described in Section 177.01(a). Only the announcement of community <br />events by community organizations is permitted in such nonpublic forum. Accordingly, <br />any proposed message must be a single event announcement. The City will publish the <br />date, time, and location of such an event open to the public, along with the title of the <br />event, so long as the title fits within the number and size of characters available on a <br />banner as defined below in Section 177.05 . Applications containing titles that are too <br />lengthy will be denied. No title will be edited by City personnel. <br />3
