Any Limited Industry-Industrial Park District use not listed above may <br />be permitted upon approval of the Planning Commission provided that: <br />(1) An interpretation that the proposed use is similar to the permitted use has first <br />been obtained from the Board of Zoning Appeals; <br />(2) Such use is not listed in any other classification of permitted buildings or uses, <br />and is more appropriate to and conforms more closely to the basic characteristics of <br />Limited Industry-Industrial Park District uses than to any other classification; and <br />(3) Such a use does not generate traffic to a greater extent than other permitted <br />uses listed in this classification, and is similar as to hours of operation of <br />other permitted uses. <br />(g) Towers for supporting commercial antennas, for wireless communication purposes <br />as provided for in Chapter 1167 on this Code. " <br />SECTION 12: That Section 1149.03 of the Zoning Code, which currently reads as follows: <br />"1149.03 USES PERMITTED. <br />(a) Mixed Use District A. Any of the uses defined in subsections (b)(1), (2) and (3) hereof <br />shall be permitted. Additionally, uses permitted in a General Retail Business District, as set forth in <br />Section 1139.01, shall be permitted provided, however, that the plan of the development area meets <br />all of the requirements and restrictions set forth in this section and Sections 1149.04 to 1149.07 and <br />further provided that the proposed use is approved by the Planning Commission, which shall <br />determine whether it has been integrated into the plan in such a manner as shall promote the intent <br />and purposes of a mixed use development. <br />(b) Mixed Use District B. Any of the uses defined in subsections (b)(1), (2) and (3;- hereof <br />shall be permitted. Additionally, the following business uses shall be permitted provided, however, <br />that the plan of the development area meets all of the requirements and restrictions set forth in this <br />section and Sections 1149.04 to 11.49.07 and further provided that the proposed use is approved by <br />the Commission, which shall determine whether it has been integrated into the plan in such a manner <br />as shall promote the intent and purposes of a mixed use development: <br />Offices-professional/business; <br />- Hotel; <br />- Banks and other financial institutions; <br />- Restaurant-freestanding full service; <br />- Restaurant/lounge within office building or hotel; <br />- Sale of books, magazines, newspapers, tobacco products, drugs, flowers, gifts and <br />stationary within office building or hotel; <br />- Barber/beauty shop, travel agency within office building or hotel; and <br />- Day care center. <br />(1) Multiple dwellings. There shall be permitted only the multiple dwelling uses <br />permitted in a Multiple Residence (Apartment) District subject to the <br />same terms, provisions, conditions and limitations imposed upon such uses <br />by Chapter 1137 with the exception that the height and story limitations <br />,. ,, ~4 ,,., ... _ ..,,,,, <br />
